This is only volume 9 of the original 12 volume set. The exterior leather is quite scuffed and worn particularly on the edges and corners. The spine area has a clear reinforcement library tape attached and the spine underneath shows the labels are missing as well as several large pieces. The internal binding of the text portion of the pages is good but both hinges at boards has also been reinforced with old library tape. There is some pulling/hinge cracking at the front end pages all the way up to the title page but everything is still attached - although the front end pages are pulling away at the top portion. The book appears complete and the book appears handwriting free no library markings etc. Pages are toned throughout the several areas showing various degrees of foxing. Scattered pages also have some smudge marks and minor chipping present. Ordered that the appeal be Dismissed and the Interlocutors Complained of be Affirmed.’ An appeal to the House of Lords in the case of the Earl of Aboyne against the Earl of Aberdeen over the behavior of the arbiter John Innes factor to the Earl of Fife. The two Earls had seen frequent border scuffles including the construction and destruction of livestock shelters in their estates in Cromar Aberdeenshire and consequently employed an arbiter to settle disputes as they arose. Aboyne complains of the arbiter’s decisions and Aberdeen responds in kind; this copy bears an annotation of the decision in favour of the latter. A reasonably scarce pamphlet with ESTC listing 8 copies evenly split between Britain and North America. It proposes an amendment to the inheritance law of Scotland with particular reference to the Entail Act 1685 a much-amended act which ‘related to a subject which affected very materially the welfare not only of landowners but of tenants and the public generally in Scotland’ according to Lord Advocate Edward Gordon seeking a further amendment in 1875. The Entail Act was finally repealed in 2004. Printed in the Year hardcover

Blue 6 penny stamp in margin. One engraved revenue stamp on exterior with "101" in the upper right-hand corner. On Sept. 5 1755 William Anne Holles Earl of Essex 1732-1799 leased to John Minn of Little Fransham Norfolk County yeoman several small tracts of farmland including a pasture called Oxmere in Little Fransham of about 10 acres. Signed at the lower edge "Essex" with his seal. Signed by the witness on the outside: Francois Gonin. In Good Condition: 2 horizontal folds and 3 vertical folds; old dampstains along one edge and at 2 junctures of folds have resulted in reduced legibility in those locations and minor loss at one juncture; otherwise clean and crisp. unknown

A dispute between the owners of the Crook Mill of Tullibole near Crook of Devon in Fossoway and the tenant farmers held in thirlage to grind their corn and malt at the mill. The tenants challenged portions of their tithe some of which was not explicitly mentioned in the mill’s original charter of 1612 while the owners contend that they only ‘demand from what any of the Sucken more than what had been immemorially and uniformly paid’. A petition on behalf of merchant Alexander Govan appealing a decision to not levy penalties on Thomas Lang flesher whose sheep ‘became an absolute nuisance to the neighbourhood breaking through all the fences and destroying every green thing’ in the fields adjoining the Glasgow to Edinburgh road near Kirkintulloch. A complaint raised by a brewer and distiller in Glasgow against his son from his first marriage who raised a claim for a bond of security that had been part of his mother’s marriage contract. Sheills alleges that it is the boy’s maternal grandfather who initiated the action and that although an illegitimate claim its public nature has harmed his credit led his creditors to impound his tools of trade and would ruin his business in respect of which he seeks damages and expenses. His Name Was Just Samuel Pufendorf Until He Was Ennobled In 1684; He Was Made A Friherre Baron By The King Of Sweden A Few Months Before His Death At Age 62 In 1694. Among His Achievements Are His Commentaries And Revisions Of The Natural Law Theories Of Thomas Hobbes And Hugo Grotius. Pufendorf Was Familiar To American Political Writers Such As Alexander Hamilton James Madison And Thomas Jefferson. His Political Concepts Are Part Of The Cultural Background Of The American Revolution. Pufendorf Is Seen As An Important Precursor Of Enlightenment In Germany. He Was Involved In Constant Quarrels With Clerical Circles And Frequently Had To Defend Himself Against Accusations Of Heresy Despite Holding Largely Traditional Christian Views On Matters Of Dogma And Doctrine. The response of William Leslie to the accusation of perjury and electoral fraud brought by Alexander Penrose-Cumming the failed candidate for parliament in Elgin and Forres in the general election of 1784. Leslie argues that Penrose-Cumming lacks standing and cannot prove any damages and also that Leslie had held a portion of an estate under a mortgage dating back to the closely fought election of 1774 when both sides were granting liferents and wadsets to increase the roll.
