Hardcover. New. $28.95 AN INFLUENTIAL THEORY OF MINORITY RIGHTS "In Calhoun's last years he drafted two essays that set forth his ideas on political theory. The first and shorter essay `The Disquisition on Government' is the more significant in that Calhoun sought to develop a consistent theory of minority rights within the context of majority rule. He urged universal recognition of the inequality of mankind and the differentiation of social and economic concerns. For an organized society to work in a harmonious and practical sense these differences Calhoun contended had to be recognized and then institutionalized. He was of course arguing for his section and its `peculiar institution' but nowhere does he mention slavery in the essay. Calhoun's thought as developed in the "Disquisition" and to a lesser extent in his `Discourse on the Constitution' remains an original contribution to the history of political theory. His assertion of pluralism in political representation has influenced diverse critics of society including liberal supporters of civil rights and conservative defenders of special social and economic interests." --JOHN NIVEN "JOHN C. CALHOUN" American National Biography 4:215-216 Secretary of war and state a two-time vice president and one of the more notable senators in U.S. history JOHN C. CALHOUN 1782-1850 was one of the greatest American statesmen of the nineteenth century. New. $28.95 Goodnow's major work this book analyzes the distinction between `politics' and `administration.' According to Goodnow politics is concerned with policy and other expressions of state will. Administration is concerned with the faithful execution of enacted legislation. He observes that administration has a tendency to overstep this boundary and concedes that politics must therefore monitor administration to keep it in line with the people's will. Reprint of first edition. While a member of the Columbia faculty Frank J. Goodnow 1859-1939 was the first individual in the United States to hold a professorship in administrative law. He became the first president of the American Political Science Association which offers an annual award in his name. He was president of Johns Hopkins University from 1915-1929. "From both the legal and historical standpoint the book contains many things that are richly suggestive. There is very little in our legal or political literature so penetrating as for example the exposition of the effects of confinement of the principle of separation of powers to the central government. . It is not written for the legal profession directly but to those lawyers who seek more than a working tool in their profession a true appraisement of the administrative law it will appeal. The writing of such a work moreover is a signal public service." --6 Columbia Law Review 1906 133. unknown books

Hardcover. $28.95 A study of secession and nullification movements in the United States from the nullification resolutions of 1798 to the American Civil War. Powell proposes that the secession of the southern states in 1861 was not a unique event in American history but the culmination of a tradition as old as the nation. Indeed he argues it was an expression of the "intense individualism which was the most potent factor in the creation of the republic" Preface. Sensitive to the continued animosity between the North and South Powell hoped that the historical context provided by his study would help to promote a spirit of reconciliation. The six attempts at nullification and secession that he examines are: the Nullification Resolutions of 1798 the plot for a northern confederacy 1803-1804 the Burr plot 1805-1806 New England nullifi cation and the Hartford Convention 1812-1814 South Carolina's attempts at nullifi cation 1832 the secession of 11 states and creation of the confederacy 1861. Though concise Rawle provides a systematic analysis of the Constitution's articles as well as its historical background and philosophy. It is also a historically significant work because it suggests that states have a right to secede from the Union. A popular textbook used in schools with large numbers of southern pupils such as the U.S. Military Academy it and is generally considered to have influenced the leaders and supporters of the Confederacy. "Though admittedly a valuable and able study Rawle's View of the Constitution stirred up controversy. Rawle himself was a Federalist but his studies in government had led him to the judgment that the Union was not irrevocable. His final chapter on "The Union" includes a detailed statement that the right of secession was necessary to the fundamental right of a people to choose their own form of government. . . . In several ways Rawle may be considered as providing the transitional step between the North and the South. His View was published midway between the inauguration of the Federal Government and the outbreak of the War Between the States." --Elizabeth Kelley Bauer Commentaries on the Constitution 1790-1860 63 WILLIAM RAWLE 1759-1836 was a pillar of Pennsylvania's legal establishment and a highly regarded attorney and educator. It had gone through at least nine editions prior to this one all of them according to Hawkins were "failures." Ruggles' classic acerbic satire of the English bench and bar was written in Latin and first performed in 1615. Designed to ridicule the language of the common law and the dullness of lawyers the play is based on events relating to a legal dispute between the vice-chancellor of Cambridge University and the mayor of Cambridge Francis Brakin. The lawyers who were the subject of the play's satire did not enjoy the work; Sir Edward Coke the Lord Chief Justice believed that he was a target of some of the barbs. The play provoked a quarrel between academics and lawyers. The lawyers responded with satirical poems and ballads which inspired responses by the academics to create a passionate controversy. Ruggle's play even had an influence in the reform of legal language in England. 64 Critical Review 333. unknown books

And yet there are those who love it!" --Daniel Webster Oral Argument March 10 1818 Dartmouth College v. Woodward Dartmouth College v. Woodward 1816-1819 established significant precedents concerning state authority and the nature of private enterprise. Dartmouth College was incorporated under a royal charter in 1769 as a private corporation. In 1816 the New Hampshire Legislature attempted to transform the college into a state institution. Daniel Webster representing the college trustees convinced the U.S. Supreme Court that the royal charter was a contract that could not be invalidated by subsequent state legislation. The court concurred. Its decision initiated a significant constitutional limitation on state authority. It also helped to define corporations as relatively unregulated private economic entities that contributed to the public sphere through enlightened self-interest. Shirley offers a vivid account of the case enriched by extensive quotation of primary archival sources. Reprint of the first edition. "The complete history of the Dartmouth college case is very curious and deserves more than a passing notice. Until within three years it is not too much to say that it was quite unknown and its condition is but little better now. In 1879 John M. Shirley published a volume entitled the 'Dartmouth College Causes' which is a monument of careful study and thorough research. Most persons would conclude that it was a work of merely legal interest appealing to a limited class of professional readers. Even those into whose hands it chanced to come have probably been deterred from examining it as it deserves by the first chapter which is very obscure and by the confusion of the narrative which follows. Yet this monograph which has so unfortunately suffered from a defective arrangement of material is of very great value not only to our legal and constitutional history but to the. unknown books

If it were nothing more it would have no interest for later generations which do not regard Blackstone as an authority upon speculative questions of politics or history and therefore do not need to have Blackstone's theories corrected or disproved. But in criticizing Blackstone's views Bentham necessarily expounds his own. As Bentham is one of the few English writers of mark upon the theory of political institutions and as his doctrine forms a link in the chain of English political philosophy we still read the Fragment of Government in order to see not how far Blackstone was wrong but how far Bentham was right.": Introduction 59. New. $29.95 This is a most curious work as it offers an analysis that now seems frozen in amber. Drawing on the example of Le Fur's Etude sur la Guerre Hispano-Americaine de 1898 Envisagee au Point de Vue du Droit International Public 1899 and similar studies Benton set out to provide an exploration of Spanish-American relations prior to and during the war. This work is critical but it leans heavily toward a pro-American point of view. He concludes for instance that American military and diplomatic objectives were achieved to varying degrees that at the end of the conflict Cuba was granted complete sovereignty and that the treaty of peace was fulfilled. Most curiously for the modern scholar he ends with the recognition that "the occasion of the recent intervention provided for in the Platt Amendment is outside the scope of this work" 291. Benton was a professor of History at Western Reserve University. unknown books
