The first English treatise devoted exclusively to family law First edition in an exceptionally well-preserved binding of this oft-cited work on the legal position of women in 17th- and 18th-century England and a key summary of the social mechanisms underpinning such works as The Taming of the Shrew. "Baron and Feme" refers to the legal fiction that husband and wife shared one legal personhood. The anonymous author of this treatise draws heavily on Sir Edward Coke's edition of Littleton aiming to codify and explain family law "in all the Circumstances of Life from the Solemnization of Marriage to the Divorce" p. vi. "Although written in English at a time when many law books were still published in Latin and law French it was clearly intended for a legally trained reader" Glover p. 75. This copy includes extensive ink annotations in an 18th-century hand suggesting a similar level of legal training. The annotations mainly cite other legal reference works but they also explicate several points of law and invoke others to challenge assertions in the text. The notes on the rear blank verso for instance observe that "the Wife's Portion consisting of Choses in action shall not upon ye husb's death be liable to his debts tho' ye husb: before marriage had made an adequate Jointure on her". Quarto modern full brown calf raised bands red morocco spine label. $3200.Original manuscript from the late 17th century with the parliamentary impeachment proceedings against 14 individuals during the reign of Charles II.The accountswritten in legible script with an index at frontbegin with the proceedings against Viscount Mordaunt charged with raping the daughter of the surveyor of Windsor Castle when Mordaunt was the castle's constable. Although they include a number of cases including that of William Penn in 1668 the clear focus is on the Popish plot a supposed conspiracy promulgated in 1678 that led to the arrest and trial of five Catholic lordsBaron Arundell the Marquess of Powis Baron Belasyse Baron Petre and Viscount Staffordall of which are recounted in this manuscript. As anticatholic hysteria waned and it became increasingly clear that the ""plot"" was a fiction the fallout entrapped more of the players: the impeachment of William Scroggs who served as the Chief Justice during the trials is detailed as is that of the Lord High Treasurer the Earl of Danby who was charged with concealing the plot and Edward Fitzharris who had attempted to implicate Danby in Sir Edmondbury Godfrey's murder in 1678 an event which fanned the flames of anticatholic hysteria. This collection represents a significant compendium of regional customary laws coutumes governing the vital territories of Picardy and the Ile-de-France during the Early Modern period.The primary work in this volume the Vermandois coutume served as the legal backbone for a vast jurisdiction. Composed in 1448 and undergoing a major revision in 1556 it governed lands that held immense religious and political prestige-specifically four of the six French ecclesiastical peerages: The Archbishopric of Reims and the Bishoprics of Laon Chalons and Noyon. The accompanying texts provide specific legal frameworks for the surrounding regions several of which mark significant printing milestones. The work describes the operation of the courts the forms of writs and the interpretation of legal terminology during the reign of Edward I of England. The work was edited by John Selden 1585-1654 but authored by an anonymous author who is sometimes referred to as "Fleta". However this was not a personal name but a title derived from the works preface which notes that it was written in Fleet Prison.It was John Selden who brought this ancient treatise to the public's attention with the first printed edition in 1647 and his substantial appended dissertation pp. 453-553 which offers rich commentary on Bracton Britton Fleta and related works. It also provides a compelling examination of the influence of Roman Imperial law in England-tracing its introduction application duration and eventual decline within the royal courts at Westminster. While Bracton is rightly celebrated as a foundational figure in the development of English legal thought Fleta deserves recognition for clarifying and illustrating complex aspects of its predecessors work.With the bookplate of John Evelyn 1620-1706 mounted on the front pastedown. The boards and spine are slightly scratched the front joint is somewhat weakened but the structural integrity of the binding is still intact. The leaves are lightly browned with an occasional stain. A faded early shelf number is hand printed on the fore-edge. The interior is generally clean with occasional brief marginalia in an early hand. A name - "John Byeith" - is neatly written in the same hand near the upper edge of the title page. End sheets are renewed in marbled paper. Carefully sealed tear at the bottom of p. 277. The rare second edition of this long-running guide to Tenants Law first published 1666 and continually updated and expanded well into the eighteenth century.
