Reprint of the first edition. One of the most controversial and feared powers of parliament attainder was the extinction of the civil rights and powers of people convicted of treason or other grave felony. Its principal consequences were the forfeiture and escheat of lands and disqualification from holding inheriting or transmitting land either directly or through descent. Especially popular during the Reign of Henry VIII bills of attainder were usually employed to punish persons who had displeased the king. Essentially abolished in 1870 they were applied to outlaws until 1932 when they were abolished altogether. As one would expect their use as a tool of reprisal caused widespread resentment. West d. 1726 appreciates this resentment but argues that bills of attainder are justifiable in certain situations and defends their use. unknown books

Hardcover. New. $28.95 AN INFLUENTIAL THEORY OF MINORITY RIGHTS "In Calhoun's last years he drafted two essays that set forth his ideas on political theory. The first and shorter essay `The Disquisition on Government' is the more significant in that Calhoun sought to develop a consistent theory of minority rights within the context of majority rule. He urged universal recognition of the inequality of mankind and the differentiation of social and economic concerns. For an organized society to work in a harmonious and practical sense these differences Calhoun contended had to be recognized and then institutionalized. He was of course arguing for his section and its `peculiar institution' but nowhere does he mention slavery in the essay. Calhoun's thought as developed in the "Disquisition" and to a lesser extent in his `Discourse on the Constitution' remains an original contribution to the history of political theory. His assertion of pluralism in political representation has influenced diverse critics of society including liberal supporters of civil rights and conservative defenders of special social and economic interests." --JOHN NIVEN "JOHN C. "The Fragment on Government is primarily a criticism. If it were nothing more it would have no interest for later generations which do not regard Blackstone as an authority upon speculative questions of politics or history and therefore do not need to have Blackstone's theories corrected or disproved. But in criticizing Blackstone's views Bentham necessarily expounds his own. As Bentham is one of the few English writers of mark upon the theory of political institutions and as his doctrine forms a link in the chain of English political philosophy we still read the Fragment of Government in order to see not how far Blackstone was wrong but how far Bentham was right.": Introduction 59. Descended from Rolle's Abridgment Viner's Magnum Opus marks the end of an era in English legal bibliography. Originally intended as a continuation of D'Anver's abridgment which ends at "Factor" Viner's work went on to become the longest and most detailed work of its kind. According to Winfield "it is the megatherium of the older abridgments. For several years we have used Viner for the purpose of getting all available references to all existing cases on three or four branches of the law and we have found his book very useful." Marvin adds that "it is a vast Index of the law" that "often rewards the labour when all other resources have failed." In addition to the Abridgment Viner 1678-1756 contributed much for the study of English law through his posthumous establishment of the Vinerian chair and Vinerian scholarships. The first holder of the Vinerian Chair was Sir William Blackstone. During his tenure he delivered the lectures that formed the basis of his Commentaries on the Laws of England. In a discussion of a later edition Holdsworth observed: "it was probably the best modern history of a particular branch of English law that had yet appeared in England. It won high praise from Pollock and Maitland. Though the more intensive study of the earlier history of our law has rendered some parts of it obsolete it is still the best history of the later stages of the law.
