The Loeb-Leopold case was one of the most fascinating and sensational trials of the twentieth century. On May 21 1924 Nathan Leopold and Richard Loeb confessed to the thrill killing of fourteen-year old Bobby Franks. Clarence Darrow led their defense team. Robert Crowe the prosecutor was an equally skillful adversary. What is more both attorneys called "alienists" to the stand who offered conflicting assessments of the defendants' mental states. Though their guilt was beyond question Darrow hoped to save them from the electric chair. His successful twelve-hour plea one of the greatest courtroom speeches in history moved the presiding judge to tears. This chronicle includes extensive excerpts from the court transcript and the complete speeches of the attorneys and "alienists. unknown books

Clark NJ: Talbot Publishing 2016. xvii 394 pp. ISBN-13: 978-1-61619-533-5. ISBN-10: 1-61619-533-9. Hardcover. New. $75. The kidnapping and murder of Charles A. Lindbergh Jr. touched off one of the most massive manhunts in the history of American crime detection and generated so much publicity at home and abroad that it was touted as the "Crime of the Century." The arrest of Bruno Richard Hauptmann in connection with the kidnapping inevitably led to the "Trial of the Century." Although Hauptmann was almost universally detested at the time of the trial the tide of public opinion began to change with his conviction. In the decades following Hauptmann's execution writers have advanced one theory after another seeking to pin the blame upon various members of the Lindbergh household and others. Almost every aspect of the crime and the investigation has been examined and critiqued-with one exception. No one has written a critical analysis of the trial itself. This book seeks to remedy that omission with an investigation and evaluation of the marshalling presentation and arguing of the evidence and a study of the post-conviction litigation. This innovative book includes: -- a thorough analysis of the evidence presented at trial by both the prosecution and defense -- a comprehensive critique of the performance of the lawyers -- a discussion of inculpatory scientific evidence available to but not used by the prosecution -- a section listing the major protagonists in the investigation and trial -- a timeline -- a modular analysis of the prosecution case -- a table of cases. After extensive experience in defending and prosecuting criminal cases JAMES M. DEDMAN III taught theory-based trial advocacy for the National College of District Attorneys for twenty-eight years at the University of Houston Law Center and the University of South Carolina National Advocacy Center. GEORGE R. DEKLE SR. was a legal skills professor at the Levin College of Law University of Florida. Before that he served for thirty years as an assistant state attorney in the Third Judicial Circuit of Florida. Dekle has authored several books on trial advocacy and legal history. unknown books

As a member of the first United States Senate Ellsworth 1745-1807 supported Alexander Hamilton's policies and was the main author of the Judiciary Act of 1789. He became Chief Justice of the Supreme Court in 1796. During his brief tenure which ended in 1799 due to poor health Ellsworth worked to expand the authority of the federal courts and extend common law procedures in appeals to equity and admiralty cases. With limited success he tried to initiate the policy of the Court's handing down per curiam opinions for the entire court rather than seriatim opinions by individual justices. This book explores the period between the onset of the American Revolution and the early 1800s through profiles of its leading figures William Lewis 1752-1819 an early abolitionist legislator and member of the state constitutional convention Edward Tilghman 1750-1815 a formidable courtroom lawyer and Jared Ingersoll 1749-1822 a judge and member of the 1787 Constitutional Convention. Interesting in themselves these studies are special because they reflect Binney's proximity to his subjects and their era. It is evident throughout that Binney drew on information shared by older members of the bar and individuals who knew Lewis Tilghman and Ingersoll. unknown books

The popular perception of the lawyer both within the legal community and beyond is no longer the Abe Lincoln of American mythology but is often a greedy cynical manipulator of access and power. In The Lawyer's Myth Walter Bennett goes beyond the caricatures to explore the deeper causes of why lawyers are losing their profession and what it will take to bring it back. Bennett draws on his experience as a lawyer judge and law teacher as well as upon oral histories of lawyers and judges in his exploration of how and why the legal profession has lost its ennobling mythology. Effectively using examples from history philosophy psychology mythology and literature Bennett shows that the loss of professionalism is more than merely the emergence of win-at-all-cost strategies and a scramble for personal wealth. It is something more profound-a loss of professional community and soul. Bennett identifies the old heroic myths of American lawyers and shows how they informed the values of professionalism through the middle of the last century. He shows why in our more diverse society those myths are inadequate guides for today's lawyers. And he also discusses the profession's agony over its trickster image and demonstrates how that archetype is not only a psychological reality but a necessary component of a vibrant professional mythology for lawyers. unknown books

He found that they provided enough common material to create a code of land warfare so he synthesized the texts of these conventions into a code containing 140 numbered articles divided into five sections. Each article is annotated with references to the conventions. When a clear ruling does not exist Holland offers his own based on precedents derived from internationally recognized authorities such as Bynkershoek and Lieber. The most impressive contribution to the bibliography of Anglo-Saxon legal sources since Thorpe and Liebermann this edition contains the texts of the Kentish laws the laws of Ine and Alfred the Great treaties with the Danes and the laws of Edward the Elder and Aethelstan. The texts are in Anglo-Saxon with English translations. Latin texts are used if the Anglo-Saxon originals were lost. "Mr. Attenborough has done a very useful work in providing a critical translation of the Anglo-Saxon dooms for English-speaking students who are unable or do not go far enough to find it needful to make use of Liebermann's great and apparently final edition. Not that advanced scholars can afford to neglect Mr. Attenborough for he shows himself fully capable of independent judgement and makes many observations deserving their attention": Frederick Pollock Law Quarterly Review 38 1922 511.
