This litigation was borught under the Racketeer Influenced and Corrupt Organizations Act known as RICO. The government filed this lawsuit to fulfill its duty to U>S> taxpayers to enforce the law protect the public treasury and prevent the tobacco industry from continuing to defraud the American public. SInce the case was filed in the view of the Senator Durbin the tobacco companies' conduct had not changed. Senator Durbin was concerned about news reports that indicated that the Department of Justice might not be aggressively pursuing the case against the tobacco industry. Despite repeated requests and ample time and opportunity to respond Senator Durbin felt that the Justice Department was unresponsive to Congressional inquiries and he flet that this lack of action was irresponsible given the potential magnitude of the case.
