In essence the Supreme Court upheld statutory schemes provding standards to govern the exercise of discretion by the jury or judge and rejected those requiring mandatory imposition of the death penalty under specified circumstances. S. 111 was primarily modeled after the Georgia statute that was upheld by the Supreme Court. The bill would provided for a bifurcated trial for treasons espionage and murder. U. S.
