Son objet est d’établir un corps de droit continu puisant dans la loi naturelle, le droit romain, le droit d’origine royale et les coutumes. On lui doit une magnifique définition de la notion « droit commun » et on notera également que le premier tome s’ouvre par la maxime « toute personne est libre » dont le rapprochement avec l’article 8 du Code civil « tout Français jouira des droits civils » marque tout à la fois l’universalisme du droit des Lumières mais en même temps la titularité d’une liberté et non de droit-créance. Il faut signaler que Coquille a placé au début du texte une introduction sur la comparaison entre le droit coutumier et le droit romain. L’édition ici présentée est la seconde qui parut, elle se présente en outre de manière assez émouvante comme un instrument de travail fortement utilisé mais demeurant agréable de consultation.

J.-L. Thireau, dans le Dictionnaire historique des juristes français (Paris, PUF 2007) qui ne mentionne pas notre édition, indique que ce traité “compte parmi les ouvrages juridiques les plus diffusés et sans doute les plus appréciés à cette époque”.
