Il y a toujours eu un large consensus sur ce point - en fait, tout au long des 60 ans d’histoire de l’Organisation. Les divergences sur le meilleur remède reflètent la confrontation politique entre ses 191 États membres. On a reproché à l’institution de manquer de légitimité, de devoir rendre des comptes et d’être inefficace avec une bureaucratie hypertrophiée. Récemment, des allégations de mauvaise gestion et de corruption dans le cadre du programme "pétrole contre nourriture" ont provoqué une crise de confiance. Le débat public a suivi les initiatives de réforme visant à élargir le Conseil de sécurité, à atteindre les objectifs du Millénaire pour le développement et à établir de nouveaux mécanismes collectifs pour protéger les droits de l’homme, lutter contre le terrorisme et réagir aux crimes contre l’humanité. Le renforcement des pratiques de contrôle, de gouvernance et de gestion visait à introduire des changements institutionnels fondamentaux. This book is the outcome of an extensive research work by Prof. Dr. Recep Çi¿dem from Harran University in Turkey. It is published within IRCICA¿s Series of Sharia Court Registers. It analyzes the records of the Ottoman Sharia law courts preserved at St. St. Cyril and Methodius National Library in Bulgaria. In the first chapter of the book the author gives information on the cases dealt with by these courts, the procedures for the appointment of the qadis (judges) and naibs (deputy judges), the terminology of judicial records, documents issued by the courts, and a number of other subjects of interest for the law historian. The second chapter is devoted to Muslim minority courts with coverage of such themes as the structure of the Sharia courts; the First Instance Court, the Court of Appeals, the High Sharia Court, relations between the Sharia courts and secular courts, administrative authorities, officials, lawyers, the extent of the power of these courts, among others. The third chapter, which is the main part of the study, examines individual registers. A total of 191 registers preserved in the library were scrutinized and documents related to each case were scanned. The Foreword of Prof. Çi¿dem explains in detail the salient features of each chapter and specifies that the third chapter focuses mainly on the Sharia courts of the independence period in Bulgaria, specifically between 1878-1945. The extensive bibliography and the index of personal names will be useful for researchers concerned.

Ahmet Cevdet Pasa was an Ottoman scholar, intellectual, bureaucrat, administrator, and historian who was a prominent figure in the Tanzimat reforms of the Ottoman Empire. He was the head of the Mecelle commission that codified Islamic law for the first time in response to the Westernization of law. The Mecelle, Islamic Code, was the new Ottoman civil law code proposed by Ahmed Cevdet Pasha for the newly established secular court system. It was based on traditional Islamic law, but also included many important modifications with the idea of updating the sharia according to the requirements of the time. It was the code that prevailed against Ali Pasha's push for the application of French Civil Law. The Mecelle combined Civil law with Islamic Law of Obligations in a final product consisting of 1,851 articles. This arduous task occupied Ahmed Cevdet until the last volume was published in 1876, for a total of about 16 years.
