Text of the resolution of a lawsuit grought by the United States Govenment over oil-bearing lands in California granted to Southern Pacific Railroad. The Government argued that Southern Pacific knew the lands contained oil when they applied for them and fraudulently concealed this information from the government. Assembled by an unknown attorney or law clerk the 19 items in this volume a 2-part transcript 15 briefs an oral argument and the opinion of U.S. Supreme Court Justice Owen J. Roberts form a documentary record of Owens v. Butler 297 U.S. 1 1936 the case that brought about the demise of the Agricultural Adjustment Act of 1933. Part of Roosevelt's New Deal this was a Federal law that aimed to raise the value of crops by paying farmers and ranchers to reduce production. The money for these subsidies was generated through an exclusive tax on companies that processed farm products. This led to a series of seven suits by processors who believed they were being taxed unfairly. The most important of these was Owens v. Butler. As framed by the plaintiff's lawyers it asserted the right of a taxpayer to question the validity of a Federal tax. The Court decided in favor of Owens ruling that the taxes instituted under the 1933 Agricultural Adjustment Act were unconstitutional under the Tenth Amendment. As argued by Justice Roberts the tax was not valid because it was established in conjunction with coercive contracts with proceeds earmarked for the benefit of farmers complying with the prescribed conditions. The court also held that the basic premise of the act paying a farmer to produce less to manipulate prices went beyond the powers of the national government. The issues raised by Owens v. Butler were addressed by the Agricultural Adjustment Act of 1938 which continue. unknown books

A blank complimentary notebook rendered unique and charming by a series of anonymous Folk Art pencil drawings 14 in all of primarily African-American figures. Some drawings are captioned and seem to be telling a story- -Where Is the Boy Here I Am Testing a Melon The Suspected Man The Weather Prophet Brother Gardener Declines Elder Toots Denies Hank Was Watching and Going Over to Sims" the latter 2 featuring men with guns. The notebook reads "Complimenst of Hancock & Briner dealers in Dry Goods Gents' Pants Hats Caps Boots Shoes and General Merchandise. Veedersburg Ind. Freese Boener & Co. Printers Danville Ill." front cover and "We present you with this book and making 'Fair Dealing and Low Prices' our motto we earnestly solicit a share of your patronage. Call and see us. Folding trade card 2.5 x 3.75 inches with views of the Union Volunteer Refreshment Saloon and the attached hospital on the front and back and text inside. Light soiling; very good. The Union Volunteer Refreshment Saloon was "staffed by volunteers and provided relief for Union troops on their way to or returning from battlefields in the South. Its services included warm meals temporary housing medical services and washing facilities. From its opening on May 27 1861 to its closing on December 1 1865 over 800000 men were assisted in this saloon and served over 1025000 meals" Smithsonian. This card was made specifically for the 50th Regiment Massachusetts Volunteers who spent December 20th 1862 to January 7th 1863 in Philadelphia before departing by sea for duty in the Port Hudson Campaign in Louisiana. The unit's regimental historian later noted that the regiment "received every attention and the most generous hospitality" at both the Union Saloon and the nearby Cooper Shop Volunteer Refreshment Saloon and concluded that "words can hardly express the kindness lavished upon the soldiers by the people of this patriotic city during the war." The interior of the card welcomes the regiment includes a roster of the field staff and line officers present in Philadelphia and provides a list of places of interest that soldiers might wish to visit while in the city.
