Although the common law played a role the colonists used it selectively and combined it with the provisions of the colony's charter local statutes and Scripture. He found that they provided enough common material to create a code of land warfare so he synthesized the texts of these conventions into a code containing 140 numbered articles divided into five sections. Each article is annotated with references to the conventions. When a clear ruling does not exist Holland offers his own based on precedents derived from internationally recognized authorities such as Bynkershoek and Lieber. Compact clearly written and well organized this work was a standard authority during the First World War. Still cited today it is also a primary source for the study of the law of land warfare from 1868 to the mid-twentieth century. unknown books

The book is also interesting for the essay "The Vocation of the Common Law" based on an address to the Harvard Law School Association June 25 1895 in which Sir Pollock calls for a reciprocal legal arrangement between the judges of the United States and Great Britain when merited by an important matter at hand. He compares the legal relationship of Great Britain and the United States to that of Great Britain and British India. His argument concludes "There is no reason why we should not live in hope of our system of judicial law being confirmed and exalted in a judgment-seat more than national in a tribunal more comprehensive more authoritative and more august than any the world has yet known." p. 21 With an appendix giving a summary view of Anglo-Saxon law before the Norman Conquest. Sir Frederick Pollock 1845-1937 was one of the greatest British judges and legal scholars of his day. His treatises on contracts jurisprudence the common law and other subjects did much to clarify and systematize English law. Several of these were standard texts that went through several editions. He is also remembered for his collaboration with F.W. Maitland on The History of English Law Before the Time of Edward I and his correspondence with Oliver Wendell Holmes which was published posthumously as The Holmes-Pollock Letters. He was educated at Trinity College Cambridge and admitted to the Bar in 1871. He taught at the University of Oxford from 1883-1903. unknown books

New. $22.95 Reprint of the sole edition. The extent of Roman influence on English common law long a keenly debated topic was subjected to careful scrutiny during the establishment of modern English legal historiography in the late 1800s. Scrutton's revisionist essay a path-breaking work that won Cambridge University's prestigious Yorke Prize evaluates and mostly discredits the work of his predecessors most notably Finlason Coote and Seebohm. In its place he offers a history from the Saxon period to his day guided by a close reading of sources. Scrutton believed that Roman law was a minor influence until it was introduced to Oxford by Vacarius. It became considerable after that watershed event an argument he advances through a close reading of Glanville and a book-by-book demonstration of Azo's influence on Bracton. "Scrutton has written what we believe to be the best essay on this subject. It will be a useful guide to the authorities for any who are investigating the history of our law while the author's own opinions are for the most part sound and sober and are clearly and modestly stated.": Law Quarterly Review 2 1886 96. unknown books

Legalism asserts that human behavior must be controlled through written law rather than through ritual custom or ethics because people are innately selfish and ignorant. The law is not effective when it is based on goodness or virtue; it is effective when it compels obedience. This is essential to preserve the stability of the State. And yet there are those who love it!" -Daniel Webster Oral Argument March 10 1818 Dartmouth College v. Woodward Dartmouth College v. Woodward 1816-1819 established significant precedents concerning state authority and the nature of private enterprise. Dartmouth College was incorporated under a royal charter in 1769 as a private corporation. In 1816 the New Hampshire Legislature attempted to transform the college into a state institution. Daniel Webster representing the college trustees convinced the U.S. Supreme Court that the royal charter was a contract that could not be invalidated by subsequent state legislation. The court concurred. Its decision initiated a significant constitutional limitation on state authority. It also helped to define corporations as relatively unregulated private economic entities that contributed to the public sphere through enlightened self-interest. Shirley offers a vivid account of the case enriched by extensive quotation of primary archival sources. Reprint of the first edition. "The complete history of the Dartmouth college case is very curious and deserves more than a passing notice. Until within three years it is not too much to say that it was quite unknown and its condition is but little better now. In 1879 John M. Shirley published a volume entitled the 'Dartmouth College Causes' which is a monument of careful study and thorough research. Most persons would conclude that it was a work of merely legal interest appealing to a limited class of professional readers. Even those into whose hands it chanced to come have probably been deterred from examining it as it deserves by the first chapter which is very obscure and by the confusion of the narrative which follows. Yet this monograph which has so unfortunately suffered from a defective arrangement of material is of very great value not only to our legal and constitutional history but to the pol. unknown books
