New. $24.95 Reprint of the first edition. Written between 1604 and 1605 De Jure Praedae On the Law of Prize which remained in manuscript until 1868 is the earliest significant legal work by Hugo Grotius 1583-1645. His discussion of prize is not restricted to issues of legality; he seeks to determine also whether the capture of enemy material is honorable or expedient. He pursues these issues through an elegant argument based on natural law. Remarkable for its intellectual finesse and literary quality De Jure Praedae is equally significant as the source of two of his most important writings. Mare Liberum 1609 is based on one of its chapters. It also contains an early version of De Jure Belli ac Pacis 1625. In this regard the book offers a valuable introduction to the issues explored in these later works. Appended to this reprint is Robert J. Fruin's valuable essay An Unpublished Work of Hugo Grotius's. Written in 1868 and later republished in English in 1925 it remains the principal study of this work. Hugo Grotius 1583-1645 a pre-eminent contributor to international legal doctrine was an influential Dutch jurist philosopher and theologian. His other works include De Jure Belli ac Pacis On the Law of War and Peace 1625 one of the great treatises on international law and Mare Liberum The Freedom of the Seas 1609 a compelling plea for free trade among nations. unknown books

In this momentous work Grotius describes the situations in which war is a valid tool of law enforcement and outlines the principles of armed combat. Though based on Christian natural law Grotius advanced the novel argument that his system would still be valid if it lacked a divine basis. In this regard he pointed to the future by moving international law in a secular direction. This edition was abridged by removing most of the quotations from "ancient historians orators philosophers and poets" which are identified in footnotes. As Whewell states in the preface they tended to "confuse the subject obscure the reasoning and weary the reader." By removing them he enhanced clarity and reduced the bulk of the work by "more than a half" vi. Though they suffered discrimination the English Jews enjoyed a measure of toleration and enjoyed royal protection. Their situation changed drastically during the reign of Edward I. After a period of intense persecution they were banished in 1290. They were not allowed to return until the time of the Commonwealth and Restoration when they were gradually readmitted. Henriques discusses the statutes and cases relating to this period and reconstructs this complex chapter in English history. unknown books

"Economic influences and legal theory combined to form the New York law of negotiable instruments during the colonial period. That the legal theory was an amalgam of Dutch civil law and elementary English common law serves to complicate the situation. Furthermore the unsettled nature of the judicial system during the seventeenth century made consistent legal development fortuitous at best and haphazard at its worst. This fluid state of economic and legal development is as fascinating in its complexity as it is baffling in its inconsistency." Introduction 3. "This brief study of the law of merchant and bills of exchange has as its background a fascinating era of legal history. Changing legal institutions and patterns of trade were typical of these early years. For the student of history as well as the legal scholar these developments are of great significance for they are the basis for the future growth of the law and the commercial supremacy of the province of New York." Though he lived in an atmosphere of political and social repression it is evident that Kant 1724-1804 was sensitive to the revolutionary spirit that was spreading throughout Europe in the wake of Napoleon's armies. Claiming that man is born with reason and an innate desire for freedom he argued that the union of these natural gifts could bring about a new sense of order and harmony in future generations. New. $24.95 The MADISON PAPERS James Madison appreciated the significance of the Federal Convention and took great care to compile an accurate report of its proceedings which were held behind closed doors. His journal which covers the period from May 14 to September 17 1787 is often referred to as "The Madison Papers" or "Madison's Notes." It remains the most complete record of the proceedings. This volume is based on the edition of 1840. Edited from Madison's original manuscripts which were purchased by the Federal government from Mrs. Madison it was published under the direction of President Jackson. The volume also includes the text of another manuscript that traces the history of American constitutionalism from 1754 to 1787 and E.H. Scott's complete "general and analytical" index. Founding father statesman and political theorist JAMES MADISON 1751-1836 was the primary author of the United States Constitution. While a member of the First Congress he drafted the Bill of Rights and helped to organize the new Federal government. Along with Alexander Hamilton and John Jay he was one of the authors of the Federalist Papers. He established the Democratic-Republican Party with Thomas Jefferson. Elected in 1809 Madison served two terms as president. He was without question one of the most influential national leaders in the early years of the United States. unknown books
