Released for publication as "No 5922" on 13 Sept. 1945 by the military government of the French occupation zone in the Tyrol. - Gostner (1914-90), a Catholic opponent of the Nazi regime, was arrested in March 1938. His book, entitled "1000 Days in a Concentration Camp - A First-Hand Report from the Concentration Camps Dachau, Mauthausen and Gusen, with authentic photographs and documents", is one of the earliest autobiographical reports published after the end of World War II, providing an eyewitness account of the cruelty and mass murder inside the National Socialists' concentration camps. - Slightly browned due to paper, front hinge splitting. Repeated ballpoint ownership of "Tomas Wolkerstorfer".

Schulenburg wirkte von 1934 bis 1941 als deutscher Botschafter in der Sowjetunion; er trat für eine Verständigung zwischen Deutschland und UdSSR ein und war maßgeblich am Zustandekommen des deutsch-sowjetischen Nichtangriffspakts vom August 1939 beteiligt. Als Mitwisser des gescheiterten Attentats auf Hitler vom 20. Juli 1944 wurde er verhaftet und am 10. November 1944 in Berlin-Plötzensee hingerichtet. First and only edition, published as volume 16 of the Proceedings of the Dutch Scientific Society: three award-winning essays in response to the Society's prize question, "Which is the basis of Dutch commerce, the cause of its increase and flourishing? What causes and contingencies have so far subjected it to change and decline? Which means are best to keep it in its present state, to promote its improvement, and to achive the highest stage of perfection?" - Van den Heuvel, registrar of the Court of Justice in Utrecht, gave the response awarded with the gold medal; it led the Society to establish an Economic Branch in the following year. In 1778 another French translation appeared. The third treatise is the first work by Cornelis Zillesen, later known as a writer on history and finance and a specialist in the field of water management. Au contraire, le présent texte constitue une œuvre essentiellement tournée vers la procédure avec en particulier le meilleur commentaire jamais réalisé de la célèbre ordonnance de 1670. Il convient de noter que l’auteur procède également à un commentaire systématique de l’ordonnance de D’Aguesseau de 1737 sur le faux et plus généralement sur l’ensemble du droit de la preuve. Au total un texte majeur et rare.

On lui doit principalement deux ouvrages : un commentaire de Decretale sur le titre De fide instrumentorum (Dupin, ref. 1730) et l’Apostelesma sur le Corpus (manque à Dupin). Il semblerait que nous présentions la cinquième édition de ce texte : on en recense la première édité à Basel en 1584 (du vivant de l’auteur) puis Genève, en 1597 et 1633, à Lyon, en 1599, 1616 et 1642), notre exemplaire à Louvain, en 1619, et la dernière à Amsterdam en 1659.

Sur un plan plus anecdotique on relève un arrêt du 22 mars 1538 du parlement de Toulouse interdisant aux docteurs Régens en l’université d’exercer des fonctions de conseil des parties. On y trouve quelques développements intéressants sur le droit de cuissage et sa vigoureuse dénonciation par l’auteur démontrant que les parlements doivent censurer les droits seigneuriaux extraordinaires et contraires aux bonnes moeurs.

Seine Geschichte der Kremsmünsterer Geistlichen verfaßte er anläßlich der Feierlichkeiten zum tausendjährigen Bestehen des Stiftes. Auch für die Geschichte Oberösterreichs von großer Bedeutung. - Exemplar aus der Stiftsbibliothek Kremsmünster, ohne die beiden Tafeln. First edition. - The second major book of the author, analyzing the underlying principles and practical outlook of the various socialist systems. It was the result of Pareto's newly found belief that human action emanated from emotion and passion rather than from reason. "The purpose of this book was to set out considered criticisms of liberal beliefs, and therefore of any doctrine based solely on reason, even socialist doctrines, whilst still recognizing the amazing catalytic effects of passions, instincts, feelings and will-power. Pareto maintained that socialism took advantage of the desire which every man has of transcending his own state, of imagining new roles for himself and his family, of building castles in the air and rationalizing them, of living in a better world. In this way socialism elaborated on powerful myths and political formulae which could be used to spur the masses into action and, through his action, bring about real changes in every sector of individual and collective life. In brief, socialism mobilized new energies. But more than that, it was a powerful and useful way of organizing the existing minorities by providing them with sufficient energy to gain political power. Liberalism calls on reason; socialism plays on feelings. And since feeling is at the root of all human action, socialism is politically more effective than liberalism. Nevertheless both ideologies have the same goal: to allow minorities to organize themselves and to adopt policies which will mobilize sufficient energy to acquire political power. Taking this analysis to its limits, Pareto discovered that a planned socialist economy produces the same results as a market economy, and that a socialist system can be equally as effective as a perfectly liberal system". - A good copy. On relèvera, parmi les cas les plus remarquables décrits le litige opposant un étudiant d’Angers à cette université sur la manière dont s’était déroulée sa soutenance de thèse (p. 291), le cas de dissolution de mariage pour froideur du mari (p. 423), qu’un condamné à la Question (à la torture), dont l’innocence est avérée, ne peut demander ni dommages et intérêts ni dépens pour autant (p. 495). Au-delà de ces figures pittoresques, on trouve dans cet ouvrage une bonne description des principales questions débattues, tant en droit civil qu’en droit canon à la date d’édition. Important corpus de décisions sur toutes sortes d’affaires notables de la fin du XVIème siècle. L’auteur, un des meilleurs avocats au Parlement de son époque fut nommé par Henri IV Conseiller d’État et historiographe.

Nous présentons ici la dernière édition qualifiée par Dupin (réf. 1454) de “rare et meilleure”.

An ardent plea for free trade, particularly the free trade in grain, and for European peace. "Free trade increases the income of the state and produces more wealth for the people [...] it also means competition and hence stable prices of bread, of wages and of everything". The author then discusses the problems caused by the present war with England and the benefits that peace would bring for all European nations, ending with a "call to philosophers, poets, artists, etc. in favour of peace". Rougier, baron de La Bergerie (1759-1836), was prefect of Yonne during the Empire and held various other public offices after the Restoration. He was a member of several learned societies and author of many books and pamphlets, most of which deal with subjects related to agriculture. - A clean copy with ample (though lightly frayed) margins. Thornton (1813-80), a writer on political economics, was an intimate friend of John Stuart Mill. "[I]n 1869 [he issued an] economical treatise, entitled 'On Labour...'. A second edition appeared next year, containing some new matter. The work was sympathetically reviewed by Mill in two papers in the 'Fortnightly Review', which were republished in vol. IV of his 'Dissertations and Discussions'; but the chapter on the origin of trade unions was treated by Brentano in his essay 'On Gilds and Trades Unions' as unhistorical. In a supplementary chapter appended to the second edition Thornton described co-operation as 'destined to beget, at however remote a date, a healthy socialism as superior to itself in all its best attributes as itself is to its parent', but added a warning that the period of gestation must not be violently shortened (On Labour, 2nd edit., p. 479).
