Softcovers printed light blue paper wraps bound with a dark blue plastic spine. 24 mechanically reproduced pages printed on one side of each sheet. Fine.</p><p>Included with the brief are copies of arguments presented to the House of Representatives favoring an impeachment inquiry: 1 "Why the Calhoun Precedent Governs and the Colfax Precedent does not". 2 mechanically reproduced folio pages. and 2 "General Arguments as to Why House of Representatives Should Not Defer to Grand Jury Proceedings". 2 mechanically reproduced folio pages. Each are printed on 13 inch high by 8-1/2 inch wide sheets stapled at top left. There is minor faint creasing to the top edges as the pages of the "arguments" overlap the brief.</p><p>RARE.</p><p>Unbeknownst to the public and most of the Nixon administration a grand jury had been impaneled on December 5 1972 and a federal investigation into political corruption in Maryland was underway. The investigation focused on Spiro Agnew's activities as Baltimore County Executive and as Governor of Maryland. It was found that Agnew had accepted bribes and kickbacks from contractors in exchange for public service contracts. In September of 1973 Agnew engaged the K Street law firm of Paul Weiss Rifkind Wharton & Garrison. Martin London became his lead attorney. London together with Jay H. Topkis and Max Gitter drafted a "Memorandum In Support of Motion" addressing the question as to whether it would be constitutional to indict or criminally try a sitting Vice President. The memorandum puts forth historical arguments as to why "the constitution bars a criminal proceeding against the Vice President of the United States". In the meantime following a precedent set in 1826 by Vice President John C. Calhoun Agnew asked the House of Representatives to initiate an impeachment investigation into bribery charges. The hope was that his name would be cleared by such an investigation. However Speaker Carl Albert after consulting the parliamentarian and other members denied Agnew's request on September 26 1973 stating that the request "relates to matters before the courts. In view of that fact I as Speaker will not take any action.at this time". On October 5 1973 Solicitor General Robert Bork responded negatively to Agnew's request to enjoin the grand jury proceedings investigating him. He provided the United States District Court for the District of Maryland with a brief stating that "considerations based upon the Constitution's text history and rationale which indicate that all civil officers of the United States other than the President are amenable to the federal criminal process either before or after the conclusion of impeachment proceedings." Spiro Agnew resigned from his office on October 10 1973 pleading no contest to a single charge of tax evasion.</p> Washington, DC, September 28, 1973. paperback

A photographic yearbook from the Albany Law School class of 1860 assembled by student Horatio Colony 1835-1917.<br /> Opened in 1851 Albany Law School is the oldest independent law school in the United States. Many of its students in the 1850s and '60s became prominent lawyers and judges.<br /> As is the custom with the professionally produced college photograph yearbooks produced by George Kendall Warren starting in the late 1850s each photograph is inscribed beneath by the sitter with his name and hometown. The album opens with professors Ira Harris Amasa Parker Amos Dean Nathaniel Harris and Levi Chamberlain. Some notable students include Alexander P. Ketchum who became a Colonel and Chief Appraiser of the Port of New York; Clayton H. Delano 1836-1920 who served eight terms as the Town of Ticonderoga's Supervisor and was elected twice to the New York State Assembly; and William S. Opdyke general counsel of the Delaware and Hudson Company. <br /> Horatio Colony 1835-1917 whose picture appears last and is unfortunately obscured by damage assembled this album. The photograph of Levi Chamberlain is inscribed to "Horatio friend and pupil." He was admitted to the bar in New Hampshire and New York in 1860; in 1869 he along with his brother George took over the management of the family business the Faulkner and Colony Woolen Mill. He held several other civic and local government positions before his death in an automobile accident in 1917. His son Horatio Jr. 1900-1977 a poet and novelist established the Colony family home as a museum upon his death.<br /> <br /> With: Autograph album containing autographs of acquaintances and some notable figures including Amos Bronson Alcott "A. Bronson Alcott" and Octavius Frothingham "O.B. Frothingham". In near matching black morocco autograph album stamped in blind and gilt extremities rubbed. With later inscription of C.W. The covers are creased and the edges are foxed and darkened with some staining or soiling to the front cover leaf. 41 pages plus an addenda leaf tipped-in at the front. The corners of several pages are creased and there is some minor foxing to the top edge of a few pages. Good.</p><p>John Gibson was an early member of the syndicate which had initially purchased a large share of the patent rights to William Woodworth's Planing Machine. His co-complainant James G. Wilson was a speculator who later invested in the rights to the Woodworth Planing Machine and who over 24 years earned more than 2 million dollars in royalties from his stake in the patent.</p><p>The cash cow which Woodworth's Planing Machine represented was threatened by George W. Beardslee's design of his Beardslee Patent Fixed-Knife Planing Machine in 1851. From Buffalo New York Beardslee immediately found himself named as one of four defendants in a lawsuit which the holders of Woodworth's patent brought to court even though his fixed-knife planer was totally different than Woodworth's cylindrical-head design. Indeed much of the pamphlet at hand compares the 2 planers elaborating on their differences.</p><p>An article titled "Beardslee's Planing Machine" published in the October 16 1852 issue of "Scientific American" states that "In the city of Albany Ahijah Jones has invested a large amount of capital in dressing lumber and has three of the Beardslee machines in active operation each of which as we learn by the Albany Argus dresses 4000 boards or planks in ten hours including all stoppages. One of these machines has planed stuff for Messrs. Boardman Gray of Albany -- the famous pianoforte makers -- which always was planed by hand heretofore no power planing machine being able to do the work. The stuff was for the 'Tuning Boards' of pianos." "Scientific American" goes on to praise the machine and in an article titled "The Beardslee Planing Machine Case" published in the November 20 1852 issue states that "The Planing Machine controversy which has been so long pending between Wilson and Gibson complainants and George W. Beardslee defendant and in relation to which a mass of testimony some 400 pages has been taken before a United States Judge has finally been adjusted the testimony adduced by the defendants being so conclusive that the application for an injunction fo restrain the use of Beardslee's machines had been abandoned."</p><p>RARE.</p> Albany: Joel Munsell, Law Printer, 1851. paperback

A graduate of Williams College Betts studied law with Thomas P. Grosvenor in Hudson NY and entered private practice in Monticello. After serving as Judge advocate of volunteers during the War of 1812 and a subsequent position as a judge advocate of general court Martial for New York's militia Betts was elected to Congress. He subsequently resumed private practice and then served on the Supreme Court of New York before being appointed to the United States District Court for the Southern District of New York by John Quincy Adams. Hardcover bound in a full calf binding titled on a leather label on the spine. An additional leather label with the number "8" is mounted on the spine. The covers are rubbed and scuffed with a few small stains. The spine is chipped with pieces out near the head and the bottom label is missing. The pagination is as follows: pages i-vi 2 1-269 1-3 and 271-526. The hinges are cracked and the first and last few pages are lightly darkened and foxed. Very good. <p>First edition. According to a statement in the catalog of the Lillian Goldman Law Library of Yale University "The 1st 240 pages of volume 1 reported by Thomas Ruffin; the remainder of volume 1.reported by Francis L. Hawks.<p>It is not surprising that a number of the cases reported here involve slaves. Trotter v. Howard was "an action of trover for a negro girl". Lynch v. Ashe "was an action of detinue for certain slaves". Tate v. O'Neal was a case involving "Some degree of discretion in the punishment of slaves" It "was an action brought against the Defendant and two others for beating the slave of the Plaintiff". The case of the State v. Ben the slave involved a 1741 act in which "a slave tried for a capital crime may be convicted on the testimony of a slave". The murder of one Samuel Skinner was the subject the State v. Poll and Lavinia slaves.<p>Thomas Ruffin 1787-1870 was a justice of the North Carolina Supreme Court and was chief justice from 1833 to 1852.<p>Francis L. Hawks 1798-1866 was an American writer historian and Episcopal priest who who practiced law briefly in North Carolina.<p>The book is from the library of Ovide Dupre 1844-1903 and is signed by him on the front pastedown. Dupre was a French Huguenot who was born in Opelousas Louisiana. He was a graduate of the University of North Carolina and was admitted to the Bar of that state. He practiced law for a few years in Raleigh. In the 1870's he moved to New York City where he had a successful career as a lawyer.<p>In addition to Dupre's distinguished signature there is a later owner's signature penned on the front endpaper and pastedown.
