The Kentucky Resolutions anonymously authored by Thomas Jefferson 1743-1826 were adopted by the Kentucky legislature in 1798. Written to oppose the passage of the Alien and Sedition Acts they initiated a debate about the respective powers of the federal government and states. The most remarkable claim advanced by the resolutions was that states had the right to nullify federal legislation. A key text for advocates of states' rights the resolutions had a profound effect on the debates that led to the Civil War. Dudley a Kentucky attorney provides a lively account of their history. In contrast to other authors which tend to focus of Jefferson Dudley emphasizes the central role played by John Breckinridge the leading member of the Kentucky House of Representatives. Indeed this book which draws extensively on his papers remains the principal study of Breckinridge's influence on the resolutions. unknown

Rice 1795. 2 volumes. lii 236; ii 379 pp. Reprinted 2005 by The Lawbook Exchange Ltd. ISBN-13: 9781584773931. ISBN-10: 1584773936. Hardcover. New. $150. Since the seventeenth century the law of nations was dominated by the theory of natural law which posited the existence of legal principles shared by all ages places and peoples. This theory shaped the work of such major jurists as Grotius Pufendorf and Selden. It was enshrined during the eighteenth century by advocates of the Enlightenment. Ward 1765-1846 rejected this theory. A Romantic he had no use for universal systems. Instead he appreciated the uniqueness of cultures and the differences between the past and the present. One of the first to apply Romantic ideas to the subject he treated the law of nations as a malleable concept that changed considerably since antiquity. unknown

"Frederick Parker Walton's Historical Introduction to Roman Law is a magisterial work that was part of the movement for the revival of Roman law teaching in the Anglo-American world." -- Introduction iii "`With the exception of the Bible there is no book which has so profoundly affected western civilization as the Corpus Juris.' With these suggestive words Dean Walton begins his clear and interesting summary of the history of the Roman Law before Justinian. Intended as an introduction to the study in Montreal of the Roman law in its modern form and especially as it appears today in the law of the Province of Quebec it is equally valuable for one who is to learn the modern Civil law and for one to whom Roman law is of interest only as a wonderful and effective example of the human intellect applied to the complex affairs of an imperial civilization. Dean Walton describes clearly and convincingly not only the history of important legal doctrines but also the constitutional history of Rome so far as it had to do with the making of law. The author's learning is evident but not obtrusive; his grasp of the subject is complete; his enthusiasm is even to a devotee of the Common Law almost contagious. Of especial value to a student of English law are his description of the growth of the commercial law at Rome his explanation of the ante-Justinian sources of law and his theory of the development of the jus gentium. In publishing in so handy a form just the facts about the history of Roman law that we most need to know Dean Walton has deserved the thanks of the profession." -- Joseph Henry Beale Jr. 17 Harvard Law Review 294 1903-1904 FREDERICK PARKER WALTON 1858-1948 studied classics at Oxford received his LLB at the University of Edinburgh and became an advocate in that city. He lectured in Roman law at the University of Glasgow before he was. unknown

New. $54.95 Spain has an extraordinarily rich legal history one that reflects Roman Gothic Arabic Papal Holy Roman and French influences. It is equally notable for its innovative and progressive nature. It was the first nation to produce a published commercial code. Aragon possessed and exercised a writ of habeas corpus during the medieval era. Medieval Spanish law witnessed the invention of democratic principles that would form the basis of the Republic of Iceland Magna Carta and the American Declaration of Independence. And as the first great colonial power Spain exported its legal ideas to the New World. This had a profound influence on the history of most Latin American nations and the Philippines. The study of Spanish and Spanish-influenced law has much to offer the student of legal history. Walton facilitates this study through lucid historical introductions notes and translations of rare source materials. unknown
