In the decades before the Civil War this classic treatise was required reading for practitioners scholars and law students. Martin an attorney and printer in New Bern North Carolina later a distinguished leader of the New Orleans bar gained distinction for this translation. Known as a source of the French Civil Code 1804 and for its influence on British contract law this treatise led Pothier to write others based on Roman and French law. Marvin quotes and endorses Sir William Jones's assessment of Pothier's treatises and their influence on common law: "For my own part I am so charmed with them that if my undissembled fondness for the study of jurisprudence were never to produce any greater benefit to the public than barely the introduction of Pothier to the acquaintances of my countrymen I should think that I had in some measure discharged the debt which every man according to Lord Coke owes to his profession." A conservative jurist known for his important study A Treatise on the Limitations of Police Power in the United States Considered from Both a Civil and Criminal Standpoint Tiedeman 1857-1903 completed this work at a time when the spirit of social and economic laissez-faire of the Gilded Age was giving way to demands for greater degrees of governmental regulation in response to the emergence of modern corporate capitalism and especially the rapid growth of Socialism Communism and Anarchism. For Tiedeman the fundamental issue is the need to control these groups in the interests of public order while preserving their rights of self-determination as guaranteed by the Constitution. He was optimistic that popular faith in the Constitution is strong enough to maintain this delicate balance. unknown

17957108s.l.: s.n. 1795. 4to pp. ii 95 1 folding genealogical chart. Extracted from a volume retaining portions of leather spine. Light soiling to front and rear. A scarce argument for the inheritance of John Stewart 7th Earl of Galloway 1736-1806 to give him a claim to the English peerage. Lord Galloway had already sat in the House of Lords as a Scottish representative peer and had done so since 1774 but faced re-election each parliament and lost his seat in the 1790 election. Whether on the strength of this argument or his service as a Lord of the Bedchamber Lord Galloway achieved his aim being created Baron Stewart of Garlies in the peerage of Great Britain in 1796 and thereby rejoining the Lords as a permanent member. Though anonymous this pamphlet was written by Eliezer Williams 1754-1820 chaplain and tutor to the Galloway family who had been enlisted to help investigate the pedigree. The table at the end mentions the death of Vice-Admiral Keith Stewart in March 1795 giving a terminus post quem for the publication. NLS and Hornel Gallery only in ESTC. ESTC T193376. 193984646Trenton: Privately Published 1939. First Edition. Octavo. Gilt-decorated cloth hardcover; 1622pp. Stamped "Complimentary Copy" with presentation inscription from the author to a Samuel D. Lenox dated November 28 1939. Title page foxed with scattered toning to contents; light external wear and soil; Very Good.

An uncommon first-hand account by a self-professed victim of legal treachery. Mrs. Vaughn recounts her adventures with the New Jersey civil court system following the death of her husband and the challenging of the will by his children. In her epilogue Vaughn concludes "I wish to remind the reader that all my trouble came as the result of lawyers for believing that they are supposed to advise one in the best way I foolilshly relied upon them." Based on the author's somewhat obsessive tone and the trial transcripts recorded here however it is unclear whether it was Mrs. Vaughn or the lawyers she hired who had the stronger grievance. The inscribee was the principal of the prominent Trenton law firm Lenox Giordano Devlin Delehey & Socey a firm apparently not involved in any of Mrs. Vaughn's various civil actions.
