"This well-written and thoroughly researched book is essential reading for anyone interested or involved in property law or in English legal history. The main text and the footnotes both contain fascinating information. Mark Wonnacott's book throws illuminating shafts of light on the political economic social and religious history of this country as well as its legal history." --LORD NEUBERGER OF ABBOTSBURY M.R. Who has not been a landlord or a tenant It is one of the most common legal relationships between people and has been since the medieval period. But there is very little academic interest in the law of landlord and tenant. Nobody before has attempted to write its history. This book shows how the rules on each point of importance have developed. Sometimes it demonstrates how a wrong turn has been taken or an important principle forgotten. But its practical use is to provide the material for understanding the old cases and to put those cases in their proper context; for it is hard for any lawyer advising on a doubtful point to say where exactly we are now without a thorough understanding of what the law once was and how and when it might have changed. Mark Wonnacott is a barrister at Maitland Chambers in Lincoln's Inn London specialising in property litigation. If it is attached to the ground he litigates about it and the dustier corners of land law are his particular favourite. He was counsel for the successful appellant in Berrisford v. Mexfield Housing Co-operative Ltd. 2011 UKSC 52 which revived the rule that a tenancy for an uncertain term is a defeasible lease for life. When not in court or writing law-books he is collecting or repairing them or trying to learn Italian without much success or appreciating wine with somewhat more success. Jenks 1861-1939 defines the doctrine of consideration as it was practiced in the 1890s and traces its evolution to its origins in the twelfth century. He argues "the doctrine of consideration was apparently unknown to the Roman jurists. It came into English law purely as a matter of accident as an incidental consequence of a special manner of proof; and it was not until it was familiar in this capacity that men perceived its value as a doctrine of substantive law." pp. 224-225 The work of no single mind this evolutionary process demonstrated that "the English nation while it has perhaps produced few individual lawyers of genius has in its corporate capacity manifested something like an unconscious genius for law." p. 225 "This little book is very suggestive and well worth the attention of any one who cares for the history of the law.": G.R.P. New. $25.95 A Comprehensive History of the Tariff System in the United States Goss shows that the tariff system assumed one of three forms during its history that often existed simultaneously: protective preventive and punitive. From an ineffective colonial system that allowed importers to avoid payment through extended credit arrangements to a somewhat less troubled system that demanded immediate cash payments in the early 1840s to a punitive system designed to stymie smugglers during the Civil War the collection of tariff duties was always problematic. This problem became more acute in the wake of industrialization and protectionism a period when direct taxes began to supplant indirect taxation as the major source of government finance. Reviewing the history of American tariff regulation Goss discerns a gradual process towards "more stringent supervision regulation and control" 88. Until The Habit of a Judge there has never been a book that offers a comprehensive history of Judges' robes and court attire in England and Wales and its adoption in Australian courts since colonisation. Richly illustrated with hundreds of colour images dating from the 12th century to the present The Habit of a Judge invitingly portrays the fascinating world of judicial and legal dress. "This astonishing collection of images from rare sources presents the definitive history of court attire in common law countries. Accompanied by an erudite commentary the spectacular colored plates are not only a delight to peruse but also a unique reference that shows how fashion and symbolism have inspired respect for the judicial process." --Thomas Lund author The Creation of the Common Law. "British cartoonists still portray judges sitting in court wearing full-bottomed wigs. In fact those wigs are worn only on ceremonial occasions. And even the shorter `bench wig' worn with traditional robes has now largely been discarded in favor of a bareheaded look with a simple zippered black shift worn over jeans and T-shirt--or nothing at all. With the aid of over 300 illustrations Daniel Yazdani painstakingly guides the reader through seven centuries of changing judicial and legal fashions." --Dr. Michael Arnheim St John's College. "Judicial costume just as courthouse and courtroom architecture symbolizes the foundations of a legal system the position of a judge in the judicial hierarchy and vis-a-vis the general public. This volume superbly documents the English tradition of judicial costume and its impact in the antipodes including jurisdictional variations at regional and local levels. Beautifully illustrated thoroughly researched this is a welcome addition to a slim literature on the subject and a significant contribution to comparative Anglo-American legal history." --William E.
