Recueil factice comprenant, en pagination continue, les traductions françaises du célèbre brûlot philosophique Dei delitti e delle pene du philosophe milanais Cesare Beccaria (1738-1794) ; il est suivi du Jugement d'un célèbre professeur et de la Réponse à un écrit intitulé Notes et observations sur le livre des délits et des peines, puis en pagination séparée, du Commentaire sur le livre des délits et des peines de Voltaire ; c'est à ce dernier que l'on doit la diffusion, en France, de cet ouvrage, publié anonymement en 1764, qui a contribué à forger la modernité pénale. "Marqué par le libéralisme et la modération de Montesquieu (Esprit des lois, 1748) et le contractualisme de Rousseau, Beccaria rejette la pratique de l'excès de l'État pénal inscrit dans l'héritage inquisitorial" (Marc Renneville. "Cesare Beccaria : réception et héritage. Du temps des Lumières à aujourd'hui". Criminocorpus [en ligne]). L'auteur appelle, entre autres, à la dépénalisation de l'homosexualité, met en avant les inégalités sociales qui peuvent conduire au vol, condamne la torture dans les interrogatoires, promeut la prison plutôt que les sévices corporels et lance un appel en faveur de l'abolition de la peine de mort, alléguant notamment que "l'expérience de tous les siècles prouve que la crainte du dernier supplice n'a jamais arrêté les scélérats déterminés à porter le trouble dans la société". Édition originale française, procurée par l'abbé Morellet à la demande de son ami d'Alembert : donnée comme publiée à Lausanne, elle fut imprimée à Paris. Très attendue, elle fut vendue à partir de décembre 1765 en librairie et connut sept éditions en six mois, portant les adresses fictives de "Philadelphie" ou "Amsterdam". Morellet a travaillé à partir de l'édition italienne de Mars 1756 (Livourne), en prenant quelques libertés, notamment dans l'ordre des chapitres, ce dont il tente de s'expliquer dans sa préface. Half-title rather clumsily bound into the first volume; a bit cracked along the gutter at the conclusion of the final pamphlet; cloth a bit sunned some light rubbing and wear and soiling; in very good condition. 3 vols in 1 8vo bound into ca. 1908 coarse library linen with leather spine labels and a paper shelfmark label viii 60; viii 251 2; 107 1 pages. In Mr. Donnellan's Case it surely will excite wonder that he from such circumstances was found Guilty. It was certainly the first and it is to be hoped it will be the last Case in which a person was convicted of having administered a poison which poison was never proved to have existed. In most of these Cases a person had been murdered.----Sir Theodosius Boughton was never proved to have been murdered; and he never would have been suspected to have died any other than a natural death or died from a mistake of the Apothecary had not Mr. Donnellan been married to his Sister." Three tracts on the nature of circumstantial evidence in capital crimes and by extension treating the consequence of executions of innocent individuals all taking as a starting point the case of John Donellan executed in 1781 for the supposed murder of his poxed and costive young brother-in-law Sir Theodosius Broughton who died after ingesting an apothecary's draught a not-unheard of consequence of Georgian medicine and whose estate on his death was to revert to Donellan's wife rather than to the deceased's mother--who herself seems to have provided much of the evidence that saw Donellan hanged. These also include accounts of a number of other cases of executions based on circumstantial evidence the whole reading as something of a jurisprudential Newgate Calendar. The second title here is annotated in early pencil with the section on the 1642 case of Thomas Harris which was much reprinted from this text in the 19th century here marked up with revisions for an unknown republication. An ex-library set with violet ink stamps and embossed stamps of the Association of the Bar Library of the City of New York with ink autograph shelfmark numbers to the verso of the first title page. 299403S.N. S.L. (Guyane) XXe siècle Très rare réplique en miniature de GUILLOTINE H: 60 cm - Long.: 31 cm - Larg.: 19 cm. Vraisemblablement du Bagne de Cayenne réalisée dans la première partie du XXe siècle en effet, certains détails représentés ici sont présents sur la guillotine de Cayenne et absents de la représentation d'autres "bois de justice". Fabrication très soignée en bois et métal très représentative du travail de certains forçats au bagne de Cayenne. Quelques vis et la corde ont été changés, objet très décoratif en bel état.

Original poster printed offset in bright blue on white newsprint measuring 55.75x45.25cm.; a bit of age-toning faint ironed-out mail folds else Very Good to Near Fine. Flyer announcing a lecture to be followed by a debate regarding capital punishment in France held at the Salle de l'Artistique in Nice March 28 1958. The lecture "Tu Ne Tueras Point!" Thou Shalt Not Kill! was delivered by the rather laconic author and screenwriter Claude Luxel known for his hand in co-writing Henri Decoin's 1949 film noir "Entre Onze Heures et Minuit" Between Eleven and Midnight and a few mystery stories and novels. The flyer also advertises a debate to follow featuring French actors and actresses mostly of the stage including Roger Monteaux of the Comédie Francaise; Andrée Florence; Yvette Maurech; René Ferral Michel Garnier and Jean Combal. A hot topic during the 1950s thanks in part to the author Albert Camus and as the prevalence of imposing capital punishment usually in the form of the guillotine though occasionally by firing squad waned. 22 people were executed between 1959 and 1981 when the penalty was abolished with the last taking place in 1977. This poster apparently unrecorded with no holdings in OCLC nor does Luxel's talk appear to have ever made it into print. Imprimerie Robaudi unknown
