La corruzione, benché in apparenza "scomparsa" dal dibattito pubblico, rappresenta un fenomeno radicato e persistente: «la varietà delle forme di corruzione e dei settori di potenziale interesse impone di ricorrere a un'azione combinata di strumenti preventivi e repressivi, che possono operare secondo comuni linee di coordinamento e integrazione» (Autorità Nazionale Anticorruzione, A.N.AC.). Trasparenza e anticorruzione, pertanto, costituiscono una sorta di «Giano bifronte» di quella pubblica amministrazione che si sta delineando alla luce delle più recenti iniziative del legislatore: due valori in continua ascesa che, per la loro trasversalità, condizionano ed indirizzano l'attività dei pubblici poteri e i rapporti tra le istituzioni e i cittadini-utenti. La trattazione, partendo da una prima analisi «penalistica» della corruzione, nel contesto dei principi regolatori della moderna P.A., sul sistema anticorruzione e trasparenza consolidatosi nel nostro ordinamento (Piani e soggetti dell'anticorruzione), poi prosegue «calando» i suddetti principi nei diversi settori in cui si esplica concretamente l'operato delle pubbliche amministrazioni, ossia attività e procedimento, pubblico impiego, contrattualistica pubblica. L'analisi si conclude con l'esame dei profili di responsabilità gravanti sul pubblico dipendente, che, in violazione dei precetti di legge, si discosta dalle regole di buona fede, correttezza ed integrità. Per queste caratteristiche, il volume, giunto alla II edizione, è particolarmente adatto a studenti e concorsisti, che sempre più di frequente nei bandi di concorso trovano a doversi confrontare con questa materia ma, allo stesso tempo, si pone anche come agile strumento di consultazione e aggiornamento per gli operatori del settore.
