General Orders No. 174 Washington October 30 1862. 2 page summary of the Military Commission trial of suspected confederate spy charged with "Lurking or Acting as a Spy" Jose Maria Rivas. Rivas who was found guilty and sentenced to death by firing squad. President Abraham Lincoln would disapprove the sentencing with a one paragraph explanation. Rivas was associated with Brigadier General Henry Hopkins Sibley in the Confederate attempt to gain control of the American southwest and the gold fields of California. While southern troops won several southwest battles including the Battle of Glorieta Pass they were forced to retreat when their supply chains were broken. 1848C14507London 1848. First Edition. Hardback. Slight rubbing otherwise very good. 8vo. pp. ix iii 165. Contemporary half light brown calf marbled boards lettered gilt on spine. A report of the case that caused a serious crisis in the professional career of Abraham Hayward Q.C. 1801 Ð 1884. He was appointed Queen's Counsel in early 1845 which was surprising to some as it was without the backing of a large legal pratice. When he was not elected a Bencher of his Inn in the usual manner it transpired that John Arthur Roebuck Q.C. 1801 Ð 1879 a politician had a past grievance that caused him to black-ball Hayward. In 1832 Hayward had made it known that Roebuck had circulated an obscene publication entitled 'What Is Love' and had therefore damaged Roebuck's prospects in the Bath election. According to Hayward in a pamphlet he wrote it was simply gossip at the time and was never intended to harm Roebuck's chances at the election. The Benchers were criticised in 'The Times' and an appeal was heard. The outcome was that the judges decided the Benchers were legally right and morally wrong. They also stated that the selection process was outmoded. However after the case Hayward virtually withdrew from legal practice. Spine and corners a little rubbed. VG. hardcover
