General Orders No. 174 Washington October 30 1862. 2 page summary of the Military Commission trial of suspected confederate spy charged with "Lurking or Acting as a Spy" Jose Maria Rivas. Rivas who was found guilty and sentenced to death by firing squad. President Abraham Lincoln would disapprove the sentencing with a one paragraph explanation. Rivas was associated with Brigadier General Henry Hopkins Sibley in the Confederate attempt to gain control of the American southwest and the gold fields of California. While southern troops won several southwest battles including the Battle of Glorieta Pass they were forced to retreat when their supply chains were broken.
