Si propone di fornire una breve ricognizione dei principali aspetti della nuova disciplina penale in materia di stupefacenti, recentemente "travolta" da alcune vicende che ne hanno apportato delle radicali modifiche. Tramite l'esame dei diversi passaggi che la disciplina ha attraversato, a partire dalla recente declaratoria di incostituzionalità, per giungere fino all'intervento legislativo del maggio 2014, l'obiettivo è quello di illustrare il nuovo quadro normativo, alla luce delle sue più recenti interpretazioni giurisprudenziali, non omettendo di raffrontarlo con la ormai superata disciplina introdotta dalla c.d. Legge Fini-Giovanardi.
