He faced charges of gun-running and threatening a Klan-sympathizing judge in 1969 and hijacked a plane to Cuba in order to escape. The Cuban authorities deported him to Czechoslovakia which was no more welcoming and Ervin was arrested in East Germany and taken back to the United States in September of that year.

Sentenced to life in prison though released after fifteen years Ervin's introduction to anarchist thought during his time in confinement permanently altered the course of his politics. He wrote Anarchism and the Black Revolution by hand and kept it hidden from the prison guards and in 1979 it was published by a New York anarchist collective as part of their "Pages from Prison" series. Ervin dedicated the 1993 second edition of his definitive treatise on Black anarchism to collective member Ginger Katz whose two-page Afterword appears in this book. He wrote:

"It was Ginger Katz who almost single-handedly arranged for the typesetting publishing and printing of the first edition and then she went out and sold them by the thousands. She had to fight to get the books published and to get a hearing for myself and other Black Anarchists who had things to say about the direction of the movement. The 'Anarchist purists' who wanted to keep the movement all white and as an Individualist counter-cultural phenomenon fought her tooth and nail."

Ervin has remained politically active since his release from prison. This is the best-known political manifesto work by an African American anarchist. Horse and Goat Peoples' Affinity Group unknown
