177320458vo containing 52 theses of between 8 and 15 pages each divided into three sections; each thesis with an elaborate engraved headpiece and either a tailpiece or a full-page engraving many signed 'Constantinus' see below; manuscript list of contents at end; some foxing and browning in places; ownership signature of Constantin on first page and on front free endpaper; a few contemporary annotations to one thesis; in contemporary sheep spine gilt in compartments raised bands skiver lettering-pieces one with 'Tom I'; boards and extremities somewhat worn. An interesting collection of dissertations on civil law presented by students at the law faculty of the University of Turin. The volume contains three dissertationes each of which is divided up into theses all of which are separately paginated and which discuss the nature and division of law the role of statue the ways of interpreting laws and the responsibilities and position of the judiciary. A full listing of the theses all of which are either very rare or unrecorded is available on request. What makes the present volume especially interesting is its condition: the title-pages of each of the theses has been removed so each begins with the text under an engraved headpiece signed 'Constantinus' sometimes with scul added sometimes fec and sometimes the date 1771. The ownership signature of Constantin on the front free endpaper and the first page of the volume suggest that this copy was bound specially for the engraver who appears also to have been a bookseller and print dealer and who also is credited with the engravings in Alberti di Villanova's Nouveau dictionnaire françois-italien of 1788; it might seem that the title-pages of the individual theses were considered superfluous if what Constantin needed was a collection of his own work. Although a lettering-piece on the spine states that this is volume one it is unknown if any further such volumes were made. No contents seemingly recorded by OCLC. Ignazio Soffietti

Court Case Concerning the ships "Endeavor" and "New York

178469504Edinburgh 1784. LAW. Edinburgh: 1784. Disbound pamphlet recounting the events leading up to the insurance fraud court case of two Scottish ship owners John McIver and Archibald McCallum. Also included are lists of witnesses. Quarto 9 1/8 x 7 1/2 inches; 232 x 190 mm. 10 pp. Disbound stabholes present. Some creasing to leaves. Overall very good. We could find no other copies on Rare Book Hub or World Cat. McIver and McCallum were co-owners of a shipping vessel the Endeavour and McCallum was also the owner of a shipping vessel the New York. Both of these vessels were insured for the the contents that they contained and both ships were intentionally damaged so that the insurance could be collected. The Endeavour was taken by American privateers who discovered holes drilled in the bottom of the ship. "The Greenock insurance scandal of 1784 rocked the commercial world of the Clyde that was already suffering badly from the disintegration of its great tobacco trade. At any other time the frauds might have gone undetected but both local and London underwriters hard-hit by the large number of Scottish ships lost during the American Revolutionary War initiated enquiries into the nature of those losses. In the first of two separate but related cases it was alleged that John Mclver and Archibald McCullum merchants in Greenock had conspired to cast away the Endeavour on a voyage to Halifax Nova Scotia in 1781 although before she could be sunk she was captured by American privateers who were understandably annoyed to find only a fraction of her manifested cargo covering the temporary bungs which her master had not yet drawn.' In the second case it was alleged that McCullum had conspired with James Herdman of Greenock and with William Foley the master to sink the New York which had sailed for New York and Philadelphia in 1783 with a cargo of tea wine and other goods part of which had been unloaded at Fairlie before the vessel left the Clyde to founder off the American coast. The cases in 1784 were the first to be tried in Edinburgh since 1751. In 1784 however the immensely long arguments of defence did not convince the Judge who delivered his "solemn judgment" that the statutes did indeed apply to Scotland. It is therefore surprising that the Solicitor General having won his point with several hours of detailed argument should in both the 1784 cases declare that he did not wish the death penalty to be imposed. Since the Endeavour had foundered after her crew had been removed by the American privateer the judge held that Mclver and McCullum could only be charged with the common law offense of stealing the cargo and not with the capital offense of sinking the ship to disguise that theft" Marine Insurance Frauds in Scotland1751-1821. Giustina: A Spanish Tale of Real Life

Ownership stamp of Lady Ulrica Thynne d. 1916 to front endpaper. A Near Fine copy with a bit of light scattered foxing throughout. Measuring 180 x 110mm and collating complete including half and full titles: 6 63 1 blank. A scarce work in translation which was only distributed among friends and family OCLC reports copies of Giustina at only 6 libraries. The present is the only example on the market. A narrative poem in three cantos Giustina is a romance set in Spain but clearly commenting on the hypocrisy of patriarchy and the English marriage economy. Driven by "that deep confiding trust which flows from the chaste Fondness only woman knows" Giustina chooses Alonzo as her mate. She is after all pure of heart and shaped by the advice that a woman should not be mercenary. The great tragedy for Giustina and Alonzo however is that economic concerns do enter into marriage. Despite returning Giustina's love "He could not brook that she whose heart he won Should stoop to poverty--by love undone!" Alonzo aware of Giustina's economic precarity if they wed -- cut off from by her father dependent on his scant earnings -- is the realist. A long separation unhappiness and ill health linked to the realization that his line will end with Giustina's death lead her father to agree to the couple's marriage and to allowing his daughter's dowry and inheritance. But alas -- upon the reunion Alonzo too has suffered such poor health that he survives only through their wedding day. The financially driven marriage system has created a young widow and ended the line of inheritance for her family committing her instead to the care of her aging father. Jackson 195.4.
