Ink note at top of one of the narrow folded section on last page:Jury of 80 Men for trial of Jorden on Tuesday 28th Inst. Waterstain -- name still quite readable -- a bit wavy but covers about the right third of both leaves as folded. No information as to date or location. Looks like it probably dates sometime in first two-thirds of 19th century. Someone might be able to narrow it down -- most juror names seem common but Plesant W. Ponder probably is not. Abraham Thornton a bricklayer was accused of the rape and murder of Mary Ashford when she was found dead the morning after a dance where the two had been seen together. Thornton admitted that the two had been consensually intimate but denied the charges of rape and murder. Eyewitness accounts backed up his story and in the absence of other evidence he was acquitted of both charges. Public outcry around his acquittal led to Mary's brother William invoking an "appeal of murder." This uncommon legal practice allowed a retrial of a defendant acquitted for murder but crucially gave the defendant the right to trial by battle. Thornton invoked that right and was released after William Ashford declined the challenge. The case resulted in the abolition of appeals by murder and thus the end of trial by battle. Despite his protestations of innocence the public was thoroughly convinced of his guilt. Unable to lead a normal life Thornton moved to the United States and settled in Baltimore Maryland. Abraham Thornton a bricklayer "was accused of rape and murder after attending a dance where he became intimate with a gardener's daughter named Mary Ashford. They left the dance together and her body was found the next morning in a deep pool of water near a local footpath. Thornton was tried at the Warwick assizes on 8 August 1817. Since the marks on Mary's body were not necessarily inconsistent with Thornton's claim that she had consented to sexual intercourse and since the times on the morning in question when Thornton was seen walking home to Bromwich suggested he could not have been with her when she met her death the jury found him not guilty. The case aroused much interest and reminded people of a similar murder of a local woman a year earlier. Many were convinced of Thornton's guilt and he was assailed in local and London newspapers. A group collected around the Birmingham solicitor William Bedford invoked the old legal process of 'appeal of murder' by which a person acquitted of murder could be tried again for the same offense. With a hired assistant Tom Graham he enticed Armstrong to Camden New Jersey and there bashed his head in with an axe which he had carefully marked with the initials of another man to throw suspicion on him. Though he remained unconscious Armstrong survived and Hunter calling at his home hastened his death by tearing the bandages from his head. Il lavoro propone l'analisi di oltre 700 sentenze penali su delitti di criminalità organizzata divenute irrevocabili, per almeno uno degli eventuali imputati, tra il 2000 e il 2006 nei quattro distretti di Corte di Appello della Regione Siciliana. Il tentativo è fare emergere cosa la macchina giustizia "vede" del fenomeno criminalità organizzata e di tipo mafioso attraverso una ricostruzione empirica della pratica giurisprudenziale. Il disegno della ricerca si concentra su alcuni classici interrogativi che riguardano la giurisprudenza penale: il rapporto tra scelta del rito processuale ed esito finale del giudizio; la relazione tra durata sia dei processi, sia dei procedimenti in rapporto alla scelta del rito; il rapporto tra status dell'imputato ed esito del processo; la possibilità di definizione e quantificazione, giudizialmente accertata, del costo economico sopportato dalle imprese come vittime o strumenti del reato. I risultati raggiunti, sulla popolazione analizzata, per un verso, ribadiscono alcuni elementi acquisiti al patrimonio conoscitivo delle recenti ricerche sul tema della criminalità organizzata e di tipo mafioso - sfatando alcuni luoghi comuni sulla durata del processo; per un altro, mettono in relazione le differenze di giudizio su casi simili, nei diversi distretti di Corte di Appello siciliani, con le diverse "culture giuridiche locali".

Il 7 aprile 1979 professori universitari, insegnanti, scrittori e intellettuali appartenenti all'area politica dell'Autonomia Operaia vengono arrestati in tutta Italia: sono accusati non solo di aver ispirato con la loro produzione ideologica le bande armate dell'ultrasinistra degli anni '70, ma anche di essere i promotori e i capi delle Brigate Rosse. È il celebre "teorema Calogero", che sancisce l'inizio di un'esperienza giudiziaria inedita e molto controversa e che coltiva l'ambizione di fornire le coordinate per una lettura risolutiva e unitaria della violenza terroristica che ha insanguinato l'Italia degli anni di piombo. Con il "processo 7 aprile" si consolida e si ridireziona la titanica supplenza giudiziaria che ha accompagnato la storia della Repubblica negli ultimi cinquant'anni, la quale ha visto all'opera l'ambiguo "giudice di scopo", cristallizzando un modus operandi che è stato definito emblematicamente "governo dei giudici". Questo libro intende superare una mancanza: quella di una storia delle pratiche processuali politiche, di un'analisi globale relativa ai meccanismi vecchi e nuovi impiegati nella giustizia politica. A partire dal paradigmatico "caso 7 aprile", questa ricerca è il primo abbozzo delle linee di tendenza di un laboratorio punitivo globale che arriva sino ai No Tav passando per il recente riuso del reato di devastazione e saccheggio e le accuse di una vasta gamma di reati condita dalla finalità di terrorismo.
