Shortly after publication Upham 1802-75 and his American publisher were sued by historian Jared Sparks and printer Charles Folsom for "piracy of the copyright" for including hundreds of Washington's private letters from The Writings of President Washington 1834-38. The case Folsom v. Marsh effectively established the "fair use" doctrine in the United States. Printed by Vizetelly and Company: London. Octavo two volumes: 443 1 blank pp. 423 1 blank xvi ads pp. Each volume with a frontispiece and decorated extra title page all steel engravings with tissue guards. In the publisher's dark blue horizontal wavy-grain cloth bindings with overall blue-printed marbling patern; blind-stamped ruled borders and bands floral ornamental surround and strapwork surround; and gilt-stamped eagle and stars device and titling. Light foxing to the prefatory and concluding leaves. Advertisements for "C. Wilmott's Circulating Library" Brighton are laid down on the front endpapers with a bookplate for "The Brownlow Memorial Hall Lending Library" Warfield to each rear pastedown. Faint staining to the fore-edge of the second volume. The spines are a bit toned with some mild rubbing to the corners and tips; otherwise very good.
