First edition. The publication of these volumes, from Mss placed at disposal by Maine de Biran's son, made it possible for the first time to present a coherent and connected view of the author's philosophical development. Maine de Biran was born Marie François Pierre Gonthier de Biran, receiving the name 'Maine' from the name of his family's property (le Maine). He became acquainted with the Idéologues Cabanis and Destutt de Tracy by winning first price in an essay contest sponsored by the Institute of France with the essay L'influence de l'habitude sur la faculté de penser. While continuing to write outstanding philosophical and psychological essays, he intensified his political activities, became a member of the Chamber of Deputies, and was made commander in the Legion of Honor.'Maine de Biran is the philosopher of the Empire who has best endured the test of time. His works were hailed by the National Institute, the Academy of Berlin, and the Academy of Copenhagen. He has been called "the reformer of Empiricism" because he was fully imbued with the sensationalism of the idéologues yet went beyond them by insisting on a distinction between active and passive faculties' (Emmet Kennedy in Historical Dictionary of Napoleonic France, 1799-1815, p. 319). - Bookplate of Bibliothèque J.C. 46400496, Paris, Edme Martin, 1651; in-4, vélin ivoire de l'époque. 12 ff.,n.ch., 740 pp.- 6 ff.n.ch. EDITION ORIGINALE. 184434352Kennebunkport Maine 1844. Folio broadsheet 11" x 16" printed in four columns recto and verso. Light scattered foxing old folds else Very Good.

On July 4 1844 Maine's Democratic Party Convention was held in Alfred. Joshua Herrick a farmer was Maine's Democratic Congressman for its First Congressional District during the 1843-1845 Session. He sought renomination. But he was challenged by Judge William Alen Hayes. Hayes's campaign manager was future Supreme Court Justice Nathan Clifford whose manipulations aroused deep resentment over lawyers' control of the democratic process. This broadside reflects those class divisions emerging within the Democratic Party.
Hayes who "is without doubt the richest man in the District-- has all the monied institutions at his control or in his interest-- all the aristocracy a queer idea in a dem. party but nevertheless true all or nearly all the Lawyers. Now what has Col. Herrick to go against this tremendous influence He is what we call self-made. has comparatively but little property but he has the confidence of the yeomanry of the District." Despite this appeal Herrick abandoned his effort to secure the Party's renomination and withdrew his name from consideration. He ran without the nomination and lost.
Not located on OCLC or the online site of AAS as of October 2017. unknown books
18252001060051Portland Me. : Printed for James Adams Jr. by David and Seth Paine 1825. First Edition. Hardcover. Good. Medical Malpractice: Early American Legal History Front board detached. 124 p. Institutional stamps on title page. First edition of a medical malpractice pamphlet from Machias Maine. The plaintiff Charles Lowell 1793-1858 was an Ellsworth ME lawyer who was thrown from his horse. Lowell was injured in the fall and he dislocated his left hip. Due to poor medical treatment the injury progressed to paralysis on the left side of his body. "Lowell sued Faxon and Hawks for malpractice and asked for $10000 in damages. In March 1823 a jury found Faxon and Hawks guilty of malpractice and awarded Lowell $1962 an extraordinary sum in the early nineteenth century. The physicians appealed the case and won the opportunity for a retrial. The jury in the second trial could not decide on a verdict and passed the case to the trial judge who awarded Lowell only $100. The defendants appealed this verdict too which led to a third trial. The jury could not decide on a verdict and Judge Weston convinced Lowell to drop the malpractice charge permanently. The volume of literature on this case far exceeded the literature published on any other suit in the century and underlines the rarity of the litigation in this period. The Lowell drama generated intense national interest and haunted the central characters for years. The series of trials reportedly cost Lowell $2000 and left him in financial ruin. Dr. Hawks spent between $2000 and $3000 on his defense and labored for years to overcome his debt." De Ville Medical Malpractice in Nineteenth-Century America pp. 13 18-19.
Shoemaker 21263.
