plein velin beige, (dos et plats muets, coiffes émoussées, qq. mq. aux coupes, des rousseurs) Les arrêts de la Roche-Flavin sont moins connus que son grand livre des « Treize parlements de France » et se trouvent assez peu. Cela s’explique par le fait qu’il ont été édités au tout début du XVIIème siècle (1ère éd. en 1617) et n’ont ensuite été repris que 70 ans plus tard. Il faut aussi souligner que l’annotateur de ces arrêts est F. Graverol avocat à Nîmes qui a donné un tour volontairement anecdotique aux observations qu’il a ajoutées au recueil d’arrêts de telle sorte que celui-ci devait probablement passer d’une certaine manière pour un ouvrage de vulgarisation. Mais c’est naturellement ce qui est susceptible de nous intéresser aujourd’hui : les passages substantiels sur la paillardise, sur les « règlements en temps de pestilence ». Il faut noter que l’ouvrage est complété par le traité des droits féodaux du même auteur, que l’on trouve très difficilement de manière séparée. Très rare édition début XVIème.

La substitution est l’acte juridique par lequel le détenteur d’un patrimoine substitue à l’héritier institué un tiers appelé à recueillir les biens pour le cas où l’héritier institué mourrait avant le testateur ou institue un héritier à charge pour lui de transmettre les biens à un tiers déterminé et déterminable (c’est la substitution fidei commissaire). Cette institution était extrêmement répandue au Moyen Âge, mais au XVIe et XVIIe siècle elle se heurta aux questions posées par le droit naturel et spécialement sur le point de savoir si la liberté de tester était de droit naturel. Il en résulta de graves controverses et l’une des principales ordonnances du chancelier d’Aguesseau au cours du XVIIIe siècle fut précisément de mettre de l’ordre dans les divergences jurisprudentielles qui s’étaient faites jour. Cette ordonnance de d’Aguesseau à la différence de celle concernant les donations ou les testaments n’a fait l’objet que de très peu de commentaires. On en compte au total trois, celui-ci étant le premier.

Le texte comprend, article par article, le projet soumis à la conférence, la synthèse des délibérations de celle-ci et le texte définitivement adopté. Il s’agit par conséquent d’une préfiguration marquante de l’avis du Conseil d’État sur le code civil. L’examen des délibérations montre une grande liberté de ton de la part des membres du Conseil.
