182788857New Orleans: A.T. Penniman & Co 1827-29. First Edition. First printing. Two octavo volumes. Early straight-grained morocco over marbled boards; gilt spine-titles; pp. lxxxiii 364; iii--xv 429pp. Half-titles present. Rubbing to board edges and spine ends with heavier rubbing at crowns and board corners; foxing generally mild more conspicuous but not obtrusive to a few gatherings in each volume. A well-preserved example in an attractive early binding Very Good. With ownership signature to both volumes of John T. Ludeling see note.

A desirable copy of this early keystone work of Louisiana history. Author François-Xavier Martin 1762-1846 born in France emigrated to North Carolina around 1783 establishing himself first as a printer and then after reading law as a legal scholar and jurist. He entered politics in 1806 and in 1809 was appointed to be the first Attorney General of the newly-acquired Territory of Orleans. As an eye witness to and active protagonist in the legal establishment of the state of Louisiana in 1812 Martin was in a unique position to pen the current history. Though the work was never a popular success - possibly due to Martin's stilted legalistic style which resulted in a work described by his contemporary Charles Gayarré as "lifeless as the minutes and records of proceedings in a court of justice" - subsequent historians have praised the History as for example ".one of the best examinations of the judicial structure from the colonial period to the early nineteenth century. Martin's History of Louisiana has withstood the test of time becoming not only a useful secondary source but also an important primary document." see Mark F. Fernandez From Chaos to Continuity : The Evolution of Louisiana's Judicial System 1712-1862. Baton Rouge: 2001.

In addition to serving as Louisiana's first Attorney General Martin served for a decade 1836-46 as Chief Justice of the Louisiana Supreme Court a fact that lends special interest to this copy of the History which bears the ownership markings of John Theodore Ludeling 1827-1891. Ludeling a prominent Louisiana-born lawyer and jurist just one generation removed from Martin would serve as the Court's Chief Justice from 1868-1877 - and no doubt would have approached the current work with special interest as both a primer on the State's early legal history as well as the product of a distinguished direct predecessor. A notable and well-preserved copy of an uncommon work. SABIN 44871. HOWES M-332. A.T. Penniman & Co unknown

Descended from Rolle's Abridgment Viner's Magnum Opus marks the end of an era in English legal bibliography. Originally intended as a continuation of D'Anver's abridgment which ends at "Factor" Viner's work went on to become the longest and most detailed work of its kind. According to Winfield "it is the megatherium of the older abridgments. For several years we have used Viner for the purpose of getting all available references to all existing cases on three or four branches of the law and we have found his book very useful." Marvin adds that "it is a vast Index of the law" that "often rewards the labour when all other resources have failed." In addition to the Abridgment Viner 1678-1756 contributed much for the study of English law through his posthumous establishment of the Vinerian chair and Vinerian scholarships. The first holder of the Vinerian Chair was Sir William Blackstone. During his tenure he delivered the lectures that formed the basis of his Commentaries on the Laws of England. 4to. 39, (1) pp. Recent boards with handwritten title on upper cover and spine. Pamphlet on the prolongation or renewal of the charter of the East India Company. The charter had expired in 1644, and agreement about the new charter would not reached before 1647. Folio (230 x 340 mm). (20) pp. With 4 lithographed plates (one folded, measuring 48 x 59 cms). (Includes): Wappen und Titel Seiner kaiserlichen königlichen Apostolischen Majestät Ferdinand des Ersten, Kaisers von Oesterreich. (20) pp. Small folio. Publication of the official titles and styles of Ferdinand, who had become emperor of Austria in 1835 and would be crowned King of Lombardy-Venetia in 1838 (a mere formality, anticipated here). Gives the long, middle, and short titles in both Italian and Latin, a detailed Italian description of Ferdinand's coats of arms (also in its full, medium, and small versions), and the Latin titles to be used in as seal legends with these coats of arms. All three versions of the arms are illustrated; in addition, a diagram explains the extremely detailed Great Coat. - A single ink annotation (to the explanation of the arms of Trieste); a tear to the folding illustration of the Great Coat has been repaired. Very rare: apart from the copy in the Austrian National Library, catalogues list a single copy in the U.S. (University of Illinois) and two in Italy (Biblioteca della Fondazione Biblioteca San Bernardino and Biblioteca della Fondazione Bruno Kessler, both in Trento). - Included is the slightly smaller German version, not illustrated, but prefixing a publication of the official decree of 23 September 1836, and giving the titles in Latin and German, the heraldic description of the various titles (annotated in red crayon and ink, taking particular exception to the description of the arms of Bregenz as turnips: "Nonsense! They are ermine tails"), and the seal legends. - Some brownstaining and a few edge flaws to the German publication. OCLC 883395896.

4to. (12) pp. Title-page printed in red and black with woodcut border. Modern marbled boards. All edges sprinkled red. First edition. A rare publication relating to the Frankfurt imperial elections of 1519, documenting the fruitless campaign launched by the French King Francis I in his attempt to be elected Holy Roman Emperor. The title-page features the "chained sartyrs" woodcut border by Hans Weiditz, a recurring illustration in Grimm & Wirsung productions. Attempting to sway the electoral committee in the French candidate's favour, this flattering address metaphorically compares the seven electors to the seven-star cluster of the Pleiades, who are said to outshine all other German princes in their power, wisdom, nobility, and splendour. Despite his efforts, which involved a bribe of 300,000 guilders, Francis lost the election to the Habsburg candidate Charles V. - Light browning; oversized title-page folded in. Foolscap folio (ca. 209 x 294 mm). Typescript on carbon paper. (194 [instead of ca. 219]) ff. Paginated, but not throughout. Draft of the "Weintz report", an important Nazi surveillance dossier on the activities of an illegal group of German legitimists, the so-called Harnier Circle, a term coined by the American historian James Donohoe in the 1960s. The group sought to restore the Wittelsbach family to rule in Bavaria from even before Hitler's rise to power in 1933 until Crown Prince Rupprecht's flight to Italy in December 1939. Based on material collected by the Gestapo, who investigated the group for several years and managed to infiltrate it since 1936, the report was prepared by Regierungsrat Weintz for the 1939 trials against the organisation. It contains profiles of prominent group members, including Adolf von Harnier (1903-45), Margarethe von Stengel (1898-1981), Heinrich Weiß (1887-1963), and Josef Zott (1901-45), and discusses issues such as Zott's relations with the German communist party, a plot againt Hitler's life (pp. 19f), and Weiß's flight to Austria in 1938 after an extramarital relationship became public (p. 91). The organisational structure and financial situation of the Harnier Circle are investigated, as are their clandestine meetings in cellars, inns, and private apartments, their efforts to recruit members and to advertise their cause through pamphlets, as well as their contacts with other political activists, including Catholic-legitimistic and separatist groups in Austria and Russia, as well as the also illegal German democratic movement. Interestingly enough, the paper describes the organisation's interactions with Crown Prince Rupprecht based on his own statement of 4 October 1939, emphasizing that Rupprecht was not at any point aware he was meeting with members of an illegal organisation. Also, it states that Adolf von Harnier had known for years that Rupprecht opposed any attempt to re-establish the monarchy, but failed to inform his comrades of his attitude, leading them to believe that Rupprecht agreed with their goals entirely (pp. 152f). - The Gestapo began arresting the activists on 4 August 1939, the number of detainees reaching 125 persons within only two weeks. The defendants were charged with preparing high treason, as well as with illegally producing and spreading written and visual material. Nine people were eventually punished, including Adolf von Harnier, who was sentenced to ten years in prison in June 1944, as well as Josef Zott, who received the death penalty in October of the same year and was executed on 15 January 1945. - The Weintz report is the most substantial contemporary source on the otherwise little-documented Harnier Circle, its extent largely surpassing the written defence by Adolf von Harnier, wherein he sought to minimize the importance of the organisation (5 May 1944). - Pages toned, minor edge wear, scattered creasing. Lacks the title-page, about 3 pages of the index, and the appendix. Among the paginated leaves, pages 113-123 are missing; 3 unpaginated leaves are inserted between 182 and 183, and another one between 128 and 129. The last part of the conclusion, discussing the impact the investigations had on the people, is incomplete. Some pencil annotations and emendations; a few passages stricken out with crayon; pencil note "R 3840" to first page. - The final report, comprising 219 pages, is kept at the Munich city archive (DE-1992-POL-1098). Donohoe mentions a privately owned 250-page copy at Prien am Chiemsee (Donohoe 130, note 91); another (possibly incomplete) copy is held at the archive for Christian-Democratic politics of the Konrad Adenauer foundation in Berlin (shelfmark: Müller, Wolfgang. 01-516: 013/1). With woodcut device on title page and one initial. Red modern cloth with giltstamped spine title. Renewal of the bilateral Treaty of Peace and Commerce of 1752 between the Netherlands and Morocco, then ruled by Sultan Abdallah IV (Moulay Abdallah ibn Moulay Ismail ibn Moulay Chérif ibn Moulay Ali of the Alaouite dynasty, styled "Keiser van de Ryken der Maroccen, Fez, Mequinez, Suz en Algarven" in Dutch). The renewal was signed at Salé, 29 June 1777, when the open-minded Mohammed ibn Abdallah was Sultan. In December same year, the Sultanate of Morocco became the first nation whose head of state publicly recognized the United States as an independent nation. - Since the late 16th century the Netherlands had been attempting to establish friendly relations with Islamic countries, such as the Ottoman Empire and Morocco, due to their common enmity with catholic Spain. The first "Treaty of Friendship and Free Commerce" between the two countries had been signed as early as 1610, offering "free access and friendly reception for their respective subjects with any need for safeguard or safe-conduct, no matter how they come to the others' territory". - Slight browning, but well-preserved.

First printed in Philadelphia the year prior, this title was intended specifically as an "impartial enquiry" to assess the oft-cited pro-slave trade justification that "the slavery of the Negroes took rise from a desire, in the purchasers, to save the lives of such of them as were taken captives in war, who would otherwise have been sacrificed to the implacable revenge of their conquerors". By examining a variety of first-hand accounts of trade and exploration on the African continent, Benezet sets out to fully discredit this assertion. He does this through outlining the influence of European factors and trading posts on local conflict, in particular emphasizing the corrupting influence that tax on slave ships had on local rulers. Alongside this, the frank descriptions of African society, government, agricultural and religious practices is designed to give a humanizing portrait of African people in their native land. This is then vehemently contrasted with accounts of the conditions of slavery, the circumstances of transportation and the treatment of enslaved people in the colonies. - Benezet published a series of pamphlets, at his own expense, explicating the horrors of slavery with a view to its abolition, most notably "A Caution and Warning to Great Britain and her Colonies […]" (1767). Ragatz writes that along with John Wollman, Benezet was one of the "chief early anti-slave trade agitators in the new world […] Benezet carried on universal propaganda and was in very close touch with British Abolitionists. This work gave young Thomas Clarkson most of the information he used in writing the Cambridge Latin prize which resulted in dedicating his life to the abolition movement". - Slightly rubbed, preliminary pages a little foxed, with the armorial bookplate of John Molesworth.
