En effet, son format n’échappe par à la déclinaison que connut le Code civil de 1804 : il fut publié aux formats in-32 (env. 10,5 cm de hauteur), le plus répandu in-8 (20 cm) et celui que nous proposons, l’in-4 (26 cm) le plus rare. Cette dernière version, imprimée à grandes marges, avait été envoyée aux différents tribunaux de province dans le but d’être annoté. Notre exemplaire, de surcroît, est relié entièrement interfolié et contient des annotations postérieurs (jusqu’en 1815) précisant les modifications ou révisions du Code.

1948142680London: 22 October 1948. He was about to lose his Army Council Outstanding signed group portrait capturing an Army Council meeting headed by the Secretary of State for War Manny Shinwell and Chief of the Imperial General Staff Field Marshal Sir Bernard Montgomery. The date of Friday 22 October clearly visible on the desk calendar is significant as it was the anniversary of the eve of Monty's great victory at El Alamein. That evening Montgomery attended an El Alamein Anniversary reunion at the Royal Albert Hall original newsreel footage of which can be seen on YouTube. However the business at hand at this meeting was almost certainly the introduction of National Service which Shinwell opposed and Montgomery promoted a bill for which had been approved in 1947. The financial crises faced by the post-war Labour government the Berlin Crisis and the exigencies of the Malayan Emergency which had begun in June of that year forced a re-think and "gave Montgomery the opportunity to argue that demobilization of troops should be retarded introducing de facto two years of National Service" as opposed to the proposed six months Strachan p. 42. The Chiefs of Staff argued for an extension of National Service to 18 months but Montgomery "with his vision of a mass Army to defend Europe" pushed for a two-year term "indeed on 19 October 1948 he threatened the resignation of the military members of the Army Council if such a measure was not conceded" ibid. In October 1950 in response to the Korean War Britain adopted two-year National Service. It is irresistible although perhaps facile to read an element of strain in the faces of the assembled company but Montgomery's announcement to Shinwell three days earlier that "he was about to lose his Army Council" left him "a bit startled" Memoirs p. 430. In addition Montgomery was not a success as CIGS; Templer seated second left described him as "the worst CIGS for 50 years" cited in Baxter p 122. "He fell out with both his fellow Chiefs of Staff and his own Army Council. Mutual contempt and personal antipathy shaped Montgomery's relations" Cohen p. 77. However despite their differences over National Service relations between Shinwell and Montgomery were cordial Monty describing the pugnacious Glaswegian in glowing terms: "Shinwell had a quick and clear brain and his heart was in the right place; he could understand and decide quickly. He and I became great friends. I used to tell him that when he was in his chair in the War Office from Monday to Friday he was excellent and just what we wanted as our political chief" Memoirs p. 385. Of the three Secretaries of State for War under whom Montgomery served Shinwell was "the best of the three". K6 with large tear. A washed copy and strongly and inexplicably pungent. Preserved in a marbled slipcase tipped with citron morocco. With stated faults and priced accordingly. VERY EARLY FRENCH PROVENCAL LAWS AND STATUTES A RARE AND IMPORTANT EDITION BEAUTIFULLY PRINTED IN AN ELEGANT BATARDE TYPE WITH THE TEXT IN HIGH RENAISSANCE FRENCH AND A WOODCUT TITLE BORDER ATTRIBUTED TO GUILLAUME LEROY. <br /> <br /> This is a significant collection of royal ordinances and edicts promulgated by Francois I for Provence more specifically for the town of Forcalquier and adjacent lands. The original sheets were printed in 1536 in the Papal city of Avignon by Jehan de Channey with a privilege; the work was then reissued with a new title-page in 1540 either in Lyon by Thibaud Payen ut Bechtel or by Channey's son Bernard ut Betz. "Perhaps the priviledge might have been usurped or contested because the true first edition of the Ordonnances was printed in Lyon by Denys de Harsy in 1536 with a privilege of three years . Thus the edition of Channey could well be only a counterfeit favored by the political position of Avignon a dependence of the Papal States" M. Rouard in the 1860 Bulletin du bibliophile p. 1404 "Note sur les editions de la 'Meygra Entrepriza' d'Antoine Arena". <br /> <br /> Francois I ordered to be printed this collection of Provencal laws which sought to consolidate his authority as king of Provence which was subject to the incursions of Emperor Charles V and to bring regional justice closer to "common" i.e. Parisian forms. Francois I strengthened royal authority through a series of reforms to control and optimize the management of the state and its territory. It was for these purposes that he had the Villers-Cotterets ordinance drawn up in 1539 certainly the best known and most enduring of his reign. He instituted French as the exclusive official language of the administration and initiated its civil status. The Montpellier Ordinance issued in 1537 gave rise to the legal deposit of printed publications from the Kingdom. <br /> <br /> The colophon on T6v which is not present in our copy reads: "Ces presentes ordonnances ont este imprimees en Avignon par Jehan de Channey l'an de grace 1536 au moys Daoust." Other copies of the 1540 reissue have additional works bound with it e.g. the Berkeley Law Library copy which collates A-T6 V4 2A-D4 E2. These added works are considered discrete bibliographical units. <br /> <br /> BIBLIOGRAPHIC NOTES: Judging from the title-page transcription in HOLLIS our Jehan de Channey edition must have a different title-page than that of Harvard Law Library; their transcription begins: "Ordonnances du treschrestien roy de frãce Francoys premier" etc. The cataloguer informs us that the 1540 edition is "the same as the 1536 Avignon edition except for a new t.p. and leaves 69142750. The son of the original printer reissued this; cf. Panzier." <br /> <br /> Whereas our copy lacks two leaves and has faults as stated we note with interest that the Friedlaender copy of the Denis de Harsy 1536 edition bound with two other works sold in 2001 at Christie's for $11162; a similar Sammelband was offered and sold by Messrs Sokol for EUR 11315. <br /> <br /> Baudrier vol. Very rare only edition and suppressed by the Cour des Aides in February 1779 because it was considered contrary to the authority of the Court, it lacked respect for its decisions and it violated the confidentiality of the decisions. This precious and scarce volume, which was not available on the market and which was suppressed in 1779, contains the work of Malesherbes during his tenure in office at the Cour des Aides, that is, the work of 25 years: the reports of the sessions of the Cour des Aides and the remonstrances. It was published with tacit permission and did not contain, in the first instance, those pleas in which Malerherbes addressed the king in quite frank language. These withheld texts were shortly thereafter nevertheless printed and inserted and they form the indispensible 10 page supplement at the end of the volume.The Court des Aides was suppressed, together with the Parliaments, by Maupeou in his attempt at reform; it played, under Malesherbes, a significient role of opposition to what the Court considered to be "royal arbitrariness" and basically shared the "constitutionalist" ideology common to most members of the Grande Robe. The Court was suppressed in 1771 and re-instated in 1774: Malesherbes was recalled to Paris with the reconstituted Cour des Aides on the accession of Louis XVI; it was at this point that he spearheaded the famous 1775 Remontrances of the cour des aides, which detailed the problems facing the regime and envisioned a total overhaul of fiscal policy. Louis XVI was so impressed with the plan -and fearful for the future of his government- that Malesherbes was appointed minister of the maison du roi in 1775. He held office as a royal minister only nine months; the Court proved intransigent in its opposition to his proposals for fiscal restraint and other reforms, including curtailing the arbitrary issuance of lettres de cachet, and he soon found himself bereft of political support. He resigned together with Turgot in 1776.- Pages 71-72 bound between pages 66-67, and with the pages 71-72 bis present, 457-8 omitted in numbering, numbers 465-66 used twice, but text complete.

Les audiences se font auprès d’Etienne Callart, docteur en droits, conseiller du roi et lieutenant au bailliage de Montcenis. La veuve de Pageot doit s’acquitter de dettes laissées par son défunt mari et d’autres litiges (f. 57v), notamment sur des biens immobiliers (maisons, vignes, bois).Elle est aux prises avec des personnages importants, notamment Odet de Montaigu, sieur de laTour Guerin et lieutenant général de la chancellerie d’Autun. A partir du f. 82 figure la déclaration d’héritage dressant la liste des biens du défunt, avec des annotations marginales de la fin du XVII e siècle (1678).Le manuscrit est par ailleurs intéressant pour sa mention des troubles de l’histoire contemporaine, notamment la menace des troupes de la Ligue (f. 1r) , faction ultra-catholique menaçant la monarchie ; Montcenis resta fidèle au roi – contrairement à sa voisine Autun – en dépit de tentatives. Il est question d’une incursion près de la porte du château de Montcenis de troupes ligueuses capturant des hommes pour obtenir des rançons en échange : « Les trouppes de la Ligue se gesterent dedans pour y surprendre tous ceux qu’ils pourroient pour les rendre prisonniers (…) » (f. 1r).Biblio : H.
